The above action not only violates the traffic safety corridor, but also hinders his family's travel...

Mr. Thuong presented: His family has a plot of land including garden land, forestry land, agricultural land, total area of ​​9,818m2, which was granted Land Use Rights Certificate No. 251 on November 20, 1996 by the People's Committee of Nghia Dan district under the name of Mr. Doan Van Binh (Mr. Thuong's father, now deceased), residing in Hiep 1 hamlet, Nghia Lien commune, Nghia Dan district. However, the entire "frontage" of the land adjacent to the traffic corridor in the area of ​​km44+700 of his family has long been occupied by Mr. Pham Duc Tien's family, residing in Hiep 1 hamlet, Nghia Lien commune (whose house is across the street) as a place to set up ornamental rocks for business.

We learned that Mr. Tien's current occupation of the traffic corridor was due to the fact that the People's Committee of Nghia Lien Commune had previously agreed to allow Mr. Tien to dump soil and rocks there. According to Mr. Truong Duc Truc - Chairman of the People's Committee of Nghia Lien Commune, in the petition sent to the People's Committee on July 2, 2009, Mr. Tien stated, "In front of my house, on the west side of National Highway 48, adjacent to the dry stream bank (now Mr. Binh's pond) 20m long... I want to dump soil and rocks there to make a parking lot and protect the safety of the traffic corridor". Therefore, on behalf of the People's Committee of the Commune, he approved "... allowing Mr. Tien to dump soil to protect the traffic corridor".

After receiving “permission” from the commune, Mr. Tien filled the ground along a 20-meter stretch of National Highway 48 adjacent to Mr. Thuong’s family’s land, and at the same time transported a large amount of ornamental rocks for sale, blocking the entire entrance to Mr. Thuong’s family’s land, violating the traffic safety corridor. The Traffic Inspectorate has repeatedly punished this. For example, on December 16, 2011, the Nghe An Department of Transport Inspectorate issued Decision No. 02022/QD-TTr.GTVT on administrative violations in the field of road traffic, fining Mr. Tien 7,500,000 VND and “forcing his family to clean up the materials and return them to the original state that had been changed due to the administrative violation”. However, throughout the past time, Mr. Tien still did not implement the above decision.

According to the verification result report No. 07/BC-TNMT of the Department of Natural Resources and Environment of Nghia Dan district dated April 6, 2012, it clearly stated: “The content of Mr. Thuong (Mr. Binh's son) reflecting that Mr. Pham Duc Tien's family gathered ornamental stones on the National Highway 48 traffic safety corridor at Km44+700 is well-founded. The land area that Mr. Pham Duc Tien requested the competent authority to resolve the land dispute between Mr. Tien's family and Mr. Doan Van Binh's family is the land located in the protection corridor of the National Highway 48 project managed by the People's Committee of Nghia Lien commune (this land area is not under the right of use of Mr. Pham Duc Tien's family and Mr. Doan Van Binh's family)".

Similarly, on November 5, 2012, the Department of Industry and Trade of Nghia Dan district also reported the results of the verification of this incident, in which it stated that "The content of Mr. Doan Van Thuong's petition reflecting that Mr. Pham Duc Tien had collected ornamental stones in violation of the National Highway 48 (Km44+700) traffic safety corridor is correct". At the same time, the People's Committee of Nghia Lien commune was assigned the responsibility to request Mr. Pham Duc Tien to move the ornamental stones out of the traffic safety corridor before November 20, 2012. However, up to now, after the prescribed deadline, Mr. Pham Duc Tien has not yet done so.

In response to the question of why the matter has dragged on for many years without being resolved, speaking with us, Mr. Nguyen Tang - Deputy Head of the Nghia Dan Industry and Trade Department, the department assigned to preside over the resolution of this matter, said: The reason Mr. Tien left the scene of his business violating the traffic safety corridor unsolved was because he wanted Mr. Tien's family to voluntarily relocate, to avoid causing disunity between the two families...

It is clear that Mr. Pham Duc Tien's family is trading in ornamental stones, violating the traffic corridor. Therefore, the People's Committee of Nghia Dan district and Nghia Lien commune need to review and clarify the responsibilities of individuals involved in allowing Mr. Tien to encroach on the traffic corridor for a long time, leading to complicated complaints. In case Mr. Tien's family does not voluntarily relocate, it is necessary to carry out enforcement to ensure the strictness of the law.
