Need to understand Decree 72 on Internet management correctly

The spirit of Decree 72 is open and Internet users have nothing to worry about.


On September 1, Decree 72 of the Government on the management, provision and use of Internet services and online information officially took effect. Although the authorities have clearly explained that Decree 72 aims to create a transparent corridor for the development of the Internet in Vietnam, the Internet user community is still concerned, and some newspapers even have incorrect explanations, causing misunderstandings for users, especially when sharing information on social networks.

Currently, many Vietnamese users still have the habit of copying and "copying" current news information or the content of articles to their personal pages instead of providing links. Some people even do not cite the source and are not aware that sharing this way also violates copyright of content and information.

According to the authorities, Decree 72 will put an end to the above situation. However, quoting a passage or writing a comment and then linking to the original page is not prohibited by Decree 72. Such a regulation is to avoid copyright infringement, which is currently hot.

As those directly involved in drafting the Decree, Ms. Nguyen Thi Thanh Huyen, Head of the Electronic Information Department, Department of Radio, Television and Electronic Information Management, Ministry of Information and Communications said: "Recently, when Decree 72 was issued, a number of domestic press agencies were very interested in the management of personal electronic information pages. Some newspapers published information that caused readers to misunderstand and were inaccurate about the content of the Decree, leading to frustration that the Decree prohibits individuals and owners of personal electronic information pages from sharing and synthesizing news."

According to Ms. Huyen, in fact, the purpose of Article 20 is to classify electronic information pages according to content and purpose of use. Articles 10 and 26 stipulate the rights and obligations of Internet users and social network users, and also provide specific and detailed regulations. There is no word that prohibits social network users from sharing or reposting news. This story is about copyright and intellectual property protection.

Thus, Decree 72 continues to allow activities of providing, searching, exchanging, and sharing information online, developing types of information online such as general electronic information sites and social networks; at the same time, clearly stipulates the conditions and procedures for registering to provide services and establish types of information online.

Article 20 of the Decree clearly classifies 5 types of news aggregators. Each model is subject to management sanctions. If an individual wants to create a news aggregator website, he/she must satisfy the regulations, have full financial capacity, human resources, technology... The news aggregator website must be managed by an organization.

Decree 72 will strictly handle fake news sites. In practice, in recent times, some organizations and individuals have taken advantage of the open environment of the Internet to serve bad intentions. Some fake news sites do not stop at causing harm to a few individuals, but also intentionally spread false information to disrupt financial and monetary information affecting the economy, or cause divisive information affecting the great national unity bloc, causing internal disunity... Therefore, Decree 72 has clearly stipulated the prohibition of "Impersonating organizations and individuals and spreading fake information, false information that infringes upon the rights and legitimate interests of organizations and individuals".

Mr. Nguyen Viet The commented: “In the process of developing Decree 72, the Ministry of Information and Communications also consulted with relevant agencies, including the Vietnam Internet Association. Looking at the history of the opening of the Internet in Vietnam, it can be seen that without the support of the state, the Internet could not have developed so quickly. As I understand it, this Decree aims to better manage the positive aspects of the Internet for socio-economic development and limit its negative aspects. The spirit of Decree 72 is very open, in line with the development of the Internet in Vietnam.Male”.

According to statistics from the International Internet Data Center, Vietnam ranks 18th out of 20 countries with the largest proportion of internet users in the world and 8th in Asia, with over 31 million people, accounting for about 35% of the population.
