Continuing to discuss the Draft Amendment to the 1992 Constitution, on the afternoon of November 5, during a working session broadcast live on television and radio in the hall, National Assembly deputies highly agreed with the Report on explanation, reception and revision of the Draft Amendment to the 1992 Constitution based on the opinions of the people and National Assembly deputies submitted by the Draft Amendment to the Constitution Committee.

In general, the opinions of the National Assembly deputies expressed their agreement with the structure and content of the Draft and believed that the Draft reflected the goals, viewpoints, major orientations, and principled issues on the nature of the State and regime as stated in the Party Resolution and the National Assembly Resolution.
In addition, the Draft Constitution reflects the thoughts and aspirations of the majority of people and is consistent with the country's situation. The working session also received many comments on all contents of the draft, especially the group of regulations on economic regime, land recovery and local government.
Many opinions assessed that the Draft Constitutional Amendments have established a mechanism to ensure the development of a socialist-oriented market economy, demonstrating innovation in the organization and operation of local governments in the direction of ensuring autonomy and self-responsibility; building a local government model with distinction in organization and authority between rural, urban and island governments.
Continue to constitutionalize the leading role of the State economic sector
Most of the opinions expressed at the discussion session agreed with the general regulation of the role of economic sectors, but it is necessary to affirm the leading role of the state economy. The delegates said that in the market economy in Vietnam, the role of the State and the state economy in guiding and regulating the economy is very important. Such a regulation is to demonstrate the economic infrastructure of the socialist regime in Vietnam. Therefore, the Constitution needs to stipulate the leading role of this sector.
Affirming that in recent development stages, the state economic sector has always played a leading role, supporting the economy, especially in the context of the world economic crisis, delegate Tran Minh Dieu (Quang Binh) analyzed that the state economy has a role in ensuring the existence of economic infrastructure, creating conditions for economic development.
Although there are still shortcomings in management, operation and business production, this type cannot be underestimated and its role needs to be further strengthened in the Draft Amendment to the 1992 Constitution.
Commenting on the group of regulations on economic regime, delegate Nguyen Hong Son (Hanoi) said that the draft needs to be written specifically to clarify the nature of the national economy, according to which the Vietnamese economy is a market economy, with direction and regulation by the State.
Agreeing with the draft regulations on the leading role of the state economic sector, delegate Son suggested clearly stating the content of the state economy including the state budget; national reserves, national assets, and national resources. Such regulations are easy to understand for the people and foreign investors, delegate Son said.
Agreeing with the constitutionalization of economic sectors, in which the state economy plays the leading role, delegate Danh Ut (Kien Giang) said that only then can we ensure the implementation of a socialist-oriented market economy as set out in the platform and strategy.
Regarding this issue, delegate To Van Tam (Kon Tum) analyzed that the existence of some weak state-owned enterprises is due to the management and operation capacity of some individuals and organizations, not due to the weakness of the entire state economic system.
Strengthening the role of Trade Unions in ensuring workers' rights and interests
Regarding the provisions on Trade Unions in Article 10 of the Draft, some opinions agreed to clearly define this organization in the Constitution to promote the pioneering role of the Vietnamese working class and affirm the great position and role of the working class and Trade Union organizations in history as well as in the period of promoting industrialization and modernization of the country; affirming the great position and role of the working class and Trade Union organizations in history as well as in the period of promoting industrialization and modernization of the country.
Delegates Dang Ngoc Tung (Dong Nai); Ma Dien Cu (Quang Ngai); Danh Ut (Kien Giang) said that continuing the constitution on Trade Union organizations is completely appropriate and reflects the Party and State's policies, especially in a multi-sector market economy, the role and position of Trade Union organizations is extremely important to protect the legitimate rights and interests of workers.
Land recovery must ensure fairness and be based on people's interests.
Commenting on the issue of land recovery, opinions said that in the current development conditions of Vietnam, it is still necessary to recover land for reasons of national defense, security, national interests, public interests and to implement socio-economic development projects.
However, land recovery for socio-economic development projects is directly linked to the interests of land users and enterprises, so it is necessary to have strict regulations, ensuring the principles of publicity, transparency and compensation.
Agreeing with the viewpoint of land recovery for socio-economic development in the current conditions of Vietnam, delegate Ma Dien Cu (Quang Ngai) said that the provisions in the draft are not clear; there are no specific regulations on land recovery for socio-economic development for what purpose and for whose benefit.
Delegate Cu proposed to clearly stipulate in the draft amendment to the 1992 Constitution the viewpoint on land conversion in two directions: compulsory land conversion and voluntary land conversion. It should not stipulate cases where the State recovers land for socio-economic development but should be assigned to the Land Law to regulate. Regarding the principle of land recovery, it is necessary to add more guarantees of fairness and based on the interests of the people, Delegate Cu emphasized.
According to delegate Nguyen Thanh Phuong (Can Tho), the Draft should stipulate that land recovery must be transparent and public, in accordance with the provisions of the law instead of "the law" because it is believed that in the future, land recovery may no longer be easy because land is a limited resource. Therefore, in the future, it may be necessary to develop a separate law on compensation and land recovery like some countries in the world to ensure the seriousness and accuracy of land recovery, ensuring the rights and legitimate interests of individuals and collectives who are land owners.
Agreeing with the Constitution on land recovery for national defense, security, national and public purposes, and socio-economic development, delegate Danh Ut (Kien Giang) proposed that land recovery in this area must ensure the principles of publicity, transparency, compensation, and ensuring the interests of land users.
Organizing local government in accordance with urban, rural and island characteristics
Regarding the local government model, through the Government's report on the summary of the pilot program of not organizing the People's Council model, delegate Nguyen Hong Son (Hanoi) proposed to amend in the direction that local government is organized in local administrative units of the Socialist Republic of Vietnam in accordance with the characteristics of urban, rural and island areas.
People's Councils and People's Committees are established in provinces, centrally run cities, districts, cities, towns, townships, and communes in districts and special economic administrative units. People's Committees are established in wards in districts, wards and communes in cities and towns.
Sharing this view, however, disagreeing with the provision in Article 114 of the draft, the People's Committee is elected by the People's Council at the same level or directly approved by the People's Council at the next higher level upon the proposal of the Chairman of the People's Committee at the same level, delegate Danh Ut (Kien Giang) said that such a provision is not consistent with the political system, because as a level of government, it must be complete and fully organized with the People's Council directly elected by the people and the People's Committee elected by the People's Council at the same level. This is consistent with the nature of the socialist rule of law State and consistent with the principle that the people exercise State power through direct democracy and representative democracy through the National Assembly and People's Councils at all levels and other organizations and agencies.
