Discussing at the 3rd Session on the Law and Ordinance Development Program 2023, National Assembly delegates said that in the coming time, we must change our perspective and increase predictability, first of all, the trend affecting legislative activities.

Proposal to study legal framework on virtual currency and virtual assets

Delegate Trinh Xuan An (Dong Nai delegation) cited the fact that recently we have determined that digital transformation will account for 20% of GDP, talking a lot about blockchain, virtual currency, digital currency, however, the legal framework for this system is not yet available. Currently, the Government has assigned the Ministry of Justice, the State Bank to coordinate with relevant agencies to study this issue.

Based on the role and potential of this field, delegates suggested that it is necessary to conduct early research to have regulations on virtual assets, virtual currencies, cryptocurrencies and crypto assets.

“Some of our games are currently worth about 9.7 billion USD, but most startups establish companies in Singapore instead of in Vietnam, because we do not have a legal framework,” Mr. Trinh Xuan An cited and suggested that this issue be thoroughly researched.

Emphasizing the need to research and rapidly develop human resources, especially high-quality human resources because this is one of the three breakthroughs in national development, delegate Tran Thi Hong Thanh (Ninh Binh delegation) said that the requirement is to create an environment and conditions to develop a modern, open labor market, and unify training efficiency to improve skills to meet labor market needs in the context of the 4.0 industrial revolution.

Furthermore, the digital economy and the digital technology era are bringing opportunities for breakthroughs in labor productivity and the development of high-quality human resources, but these opportunities are also challenges, requiring innovations in state management of training, development and labor use.

"From that reality, I suggest that the Government should study and supplement the draft Law on Employment (amended) to include in the program" - the female delegate expressed her opinion.

Delegate Le Xuan Than (Khanh Hoa delegation) expressed his interest in the Commercial Law and the Law on Commercial Arbitration.

Because, the Commercial Law was issued by the National Assembly in 2005, it has been 17 years now while the business situation and commercial activities of the country and even international business have developed almost every day, every hour. Currently, e-commerce is regulated by decrees and circulars, there has been no fundamental amendment to the law.

Similarly, the Law on Commercial Arbitration, which came into effect in 2011, does not yet have a mechanism to be open and efficient in resolving commercial disputes in order to attract investment and all activities related to resolving disputes quickly, effectively, publicly and transparently.

"I think we should raise the issue of amending these two laws along with the Law on Electronic Transactions and a number of legal documents in sync with our country's market economy" - Mr. Le Xuan Than expressed his opinion.

Meanwhile, delegate Nguyen Van Canh (Binh Dinh delegation) wants to institutionalize the policy of encouraging and protecting dynamic, creative cadres who dare to think, dare to do, and dare to make breakthroughs for the common good, so breakthroughs are needed in policies and in management work.

“Breakthroughs often precede the law or the law has been prescribed, but in some cases, they need to be ignored to achieve higher results for the common good. To have a breakthrough and still comply with the Constitution, we need a Law on Protection of People Who Dare to Think and Dare to Do. At this time, it may conflict with many other laws, but if the National Assembly agrees, when there is a conflict between laws, the Law on Protection of People Who Dare to Think and Dare to Do will have higher legal value, then the policy of protecting people who dare to think and dare to do for the common good will soon come into life,” the National Assembly delegate from Binh Dinh proposed.

In a more specific analysis, Mr. Nguyen Van Canh said that the Law on Protection of People Who Dare to Think and Dare to Do will have two parts. One is the part where individuals and organizations decide on tasks that are not yet regulated by law. The other is the part where individuals and organizations decide on tasks that are contrary to current law, and in each case, there are regulations to collect collective opinions, opinions of the Front, and opinions of different leaders and superiors. The content of those decisions is decisions for the common good and must bring great benefits.

For example, that decision will help increase the local growth rate by 1%, help increase the local budget by 10%, help speed up the speed of important local infrastructure projects by 50%. These numbers need to be scientifically proven. Those decisions also do not affect the legitimate interests of people and businesses. Individuals and organizations will be commended and rewarded when their decisions are groundbreaking, bringing benefits to create a spread in society./.
