Need to resolutely collect export and import tax debts

By the end of November 2012, Nghe An Customs had collected 513/820 billion VND in import-export tax, reaching nearly 63% of the 2012 plan. The amount of bad import-export tax debt at enterprises is currently 40.4 billion VND. However, when the Customs sector took enforcement measures, these enterprises either had no money in their accounts or could not verify their status.

The amount of bad import-export tax debt at enterprises is currently 40.4 billion VND. However, when the Customs sector took enforcement measures, these enterprises either had no money in their accounts or could not verify their status.

At Thuy Trang Trading Joint Stock Company (No. 1, Vo Nguyen Hien, Hung Binh Ward - Vinh City), the Anti-smuggling and Violation Handling Department (CBL & XLVP) of Nghe An Customs has verified this asset, but the result is that there is no asset in the name of the enterprise. During the asset verification process on August 31, 2012, the enterprise paid an additional 40 million VND in import-export tax. According to Official Dispatch No. 675/CCT-KTr2 dated September 12, 2012 of Vinh City Tax Department sent to Nghe An Customs, Thuy Trang Trading Joint Stock Company is still operating normally and has submitted a complete tax declaration. Regarding assets, the company is not registered at Vinh City Tax Department. This company has not yet dissolved or suspended business. Thus, this company still owes 21,788,875 VND in taxes and has no assets to enforce.

Trung Hoa Company Limited (No. 60, Nguyen Thiep Street, Block 7, Trung Do Ward, Vinh City), currently owes 313.6 million VND in import-export tax. The Department of Taxation and Tax Administration has verified the assets in Trung Do Ward, and the results show that the company has no assets. Mr. Vo Vinh Quang - Director of Trung Hoa Company Limited confirmed by the working minutes that the company currently submits full tax reports every month, pays full business license tax but does not generate any production and business activities. Verification at the Nghe An Tax Department also shows that the company has not registered its assets with the tax authority. The Department of Taxation and Tax Administration conducted verification at the Business Registration Office of the Department of Planning and Investment and also showed that this company has not submitted documents for dissolution or temporary suspension of business. Thus, the "assets" of this company are only in the business registration form with the number of shares, contributed capital and commitments of the company members.

Nghe An Trading and Investment Company Limited, No. 14 A, Le Loi, Vinh City, currently owes 963,178,000 VND in import-export tax. The Department of Taxation and Tax Administration also verified in Hung Phuc Ward where the company is headquartered, and the results also showed that this company has no assets. Working with Mr. Le Quang Hung - Director of Nghe An Trading and Investment Company Limited, he also confirmed that the company currently has no assets. Thus, the "assets" of this company are only on the business registration certificate.

Currently, according to a report by Nghe An Customs, there are 9 enterprises that owe taxes but have been dissolved with a debt of 3.6 billion VND; 17 enterprises have disappeared or absconded with a tax debt of 9.5 billion VND; 9 enterprises are waiting to have their debts cleared with a tax debt of 9.3 billion VND and 9 enterprises are slow to pay a debt of 18 billion VND.

Many enterprises in Nghe An that owe import-export taxes have "run away" or suddenly "disappeared" such as: Duc Toan Company Limited currently owes 248.4 million VND; Binh Minh Company Limited owes 3.2 billion VND; Anh Duong Company Limited owes 1.33 billion VND; Bac Truong Son Import-Export Company owes 1.4 billion VND; Ha Chau Trading and General Company Limited owes 1.4 billion VND... Some enterprises in other provinces have also "disappeared" such as: Ha Tinh Minerals and Trading Company; Viet Huong Import-Export Company Limited owes 1.02 billion VND...

It can be seen that, for the above mentioned bad import-export tax debts, Nghe An Customs was "slow" compared to enterprises, because after a few "deals", enterprises disappeared, fled or filed for dissolution, bankruptcy, and "defaulted" on tax. Meanwhile, the debt settlement and debt collection work was carried out quite a long time later. For example, Phuc Tho Company Limited was dissolved in 2009, but it was not until 2012 that Nghe An Customs verified and collected the debt. Or Thanh Dam Trading and Investment Company Limited, Vinh City Tax Department confirmed that it had closed its tax code in 2009, but it was not until September 2012 that Nghe An Customs verified the status of the enterprise... Finding "missing" or absconding enterprises can be said to be not difficult when Customs coordinates with security agencies. As for tax debt collection, if they continue to "give debts" or are not determined, the tax debt will inevitably increase.
