According to Decree 174/2013/ND-CP regulating administrative sanctions in the fields of post, telecommunications, IT and radio frequencies recently issued by the Government, from January 15, 2014, international domain name registrars in Vietnam who do not guide organizations and individuals registering to use international domain names to notify the Ministry of Information and Communications of information as prescribed on the network environment will be fined from 5 to 10 million VND.

This penalty is also applied to international domain name registrars in Vietnam who do not report the update of the list of international domain names they are managing to the Ministry of Information and Communications via the network environment in accordance with regulations on management and use of Internet resources; Provide international domain name registration services in Vietnam but are not enterprises established under Vietnamese law; Do not develop or do not publish forms, processes and procedures for registering “.vn” domain names in accordance with regulations of the Ministry of Information and Communications; “.vn” domain name registrars provide incorrect instructions and advice to organizations and individuals on regulations on registration and use of “.vn” domain names.

For the act of providing domain name registration and maintenance services to organizations and individuals but not ensuring to keep complete, missing or inaccurate information as prescribed, the fine is from 10 to 20 million VND.

The Decree also stipulates a fine of 20-30 million VND for ".vn" domain name registrars who violate one of the following acts: Not having measures to ensure safety and security for domain names of organizations and individuals registered on their domain name server system (DNS); Speculating on domain names in any form when providing the national domain name ".vn"; Obstructing organizations and individuals from registering to use legal domain names; Illegally preventing organizations and individuals from changing ".vn" domain name registrars.

As for domain name registrars that do not provide information, provide incorrect information, do not cooperate or do not fully cooperate with competent state agencies in handling cases related to domain names under their management; “.vn” domain name registrars that do not implement measures to ensure the safety of domain name data; “.vn” domain name registrars in the country that do not use the primary domain name server (Primary DNS) using the Vietnamese national domain name “.vn” when providing DNS services; Provide Vietnamese national domain name “.vn” services when not being a “.vn” domain name registrar or not having an agency contract with a domestic “.vn” domain name registrar…. shall be fined from 30-50 million VND./.
