Rectifying state management of mineral activities

In recent times, the situation of mineral exploitation in the province has become more complicated, with frequent serious accidents causing great damage to people and property; the situation of loss of security and order, social evils and gangster-like behavior is increasing. Local authorities and departments, branches and sectors have not taken effective preventive measures; some local authorities have been lax in management and have shown signs of protecting and covering up illegal mining activities.


To rectify the above situation, on May 17, 2011, the Provincial People's Committee issued Official Dispatch No. 2546/UBND-TN requesting:


1. People's Committees of districts, cities and towns.


1.1. Direct functional departments, offices, People's Committees of communes, wards and towns to closely coordinate with mass organizations to organize propaganda and mobilize local people to strictly comply with the State's laws, not to exploit and not to cover up or assist illegal mineral exploitation activities; mobilize village elders, village chiefs, households and residents to participate in state management of mineral activities in the locality;


1.2. Strictly handle illegal mineral exploitation activities such as: taking advantage of converting the purpose of garden land, agricultural land (digging ponds for fish farming, improving garden land, rice fields, etc.) to exploit minerals; exploiting minerals when the mine has expired, the mine has been revoked, the mine is suspended or temporarily suspended; exploiting minerals when the mine has just been licensed for exploration or is in the process of applying for a license for mineral exploration and exploitation; exploiting minerals in areas that have not been granted a mine.


Violations during the mining process by mine owners such as: mining in the wrong process, outside the licensed area, not completing procedures according to regulations, violations of labor use, environment, labor safety...


1.3. Inspect, clarify responsibilities and take strict measures to handle violations by organizations and individuals responsible for state management of mineral activities who have committed acts of abetting, protecting, covering up, and loosening management work;


1.4. The People's Committees of the districts: Tan Ky, Quy Hop, Quy Chau; Tuong Duong, Que Phong, Ky Son report the results of implementing the above contents and propose and recommend the Provincial People's Committee to resolve issues beyond their authority before May 30, 2011.


2- Provincial Police:


2.1. Direct the Public Security of districts, cities and towns to properly perform the functions and tasks of law enforcement agencies in the area; proactively advise local Party committees and authorities in the field of mineral management;


2.2. Establish working groups to deploy, sweep, repel, and strictly handle violations of the law to restore order and discipline in the field of mineral activities;


2.3. Develop a budget estimate for the campaign to suppress illegal mining activities.


3. Department of Natural Resources and Environment.


3.1. Proactively inspect and advise the Provincial People's Committee on measures to strengthen the management of mineral exploitation and processing activities in the province;


3.2. Take the lead in coordinating with relevant sectors and local authorities to review, select and advise the Provincial People's Committee to assign enterprises with real capacity, experience in mineral exploitation, and financial capacity to manage, protect, explore, exploit and process mines that have no owners and often have illegal mineral exploitation activities;


3.3. Urge districts, cities and towns to implement the contents according to the direction of the Provincial People's Committee.


4. Department of Finance:


Advise on funding for the activities of the Inspection and Sweeping Team established by the Provincial Police.


5. Departments: Construction, Industry and Trade, Labor, War Invalids and Social Affairs:


Proactively carry out inspection and examination of the implementation of mineral exploitation and processing procedures, use of industrial explosives, labor use and occupational safety and hygiene in mineral exploitation and processing areas.


Requesting Heads of departments, branches, and sectors; Chairmen of People's Committees of districts, cities, and towns to seriously implement; any agency or unit that does not seriously implement the above contents, the Head of that agency or unit must take full responsibility before the Chairman of the Provincial People's Committee and before the law.
