There are areas with new tiled houses and colorful painted walls, located not far from National Highway 1A. Most of these households build houses on 2-rice land or reclaimed land. Ms. Ng.TM in hamlet 18 showed us the rice fields in Quynh Vinh, which are also being surrounded by walls by some people in preparation for building houses. Secretary of hamlet 21, Quynh Vinh commune, Mr. Nguyen Duc Tuy, admitted that hamlet 21 has 2 households that have illegally built huts and walls on new rice land and have been administratively sanctioned by the commune.

Chairman of Quynh Vinh Commune People's Committee, Mr. Le Van Ky said: The situation of people building illegal houses in Quynh Vinh has been happening for many years, mainly in the Ru Dat area, this area used to be a low, bare hill of the commune. Initially, a few households built small houses to live in and then each year a few more households were added. In 2005, the commune requested a plan for 130 residential plots, of which 60 plots were in Ru Dat, but could not clear the land in Ru Dat because households had built illegal houses. Some households not only occupied land to live in but also occupied land to sell to other households. The commune has handled administrative violations, even enforced evictions. Recently, the commune organized enforcement against 3 households but after that, people continued to build.

Quynh Lap - a coastal commune, 12 km east of Hoang Mai town center. In many hamlets such as Tam Hop, Dong Luc, Hop Tien, Quyet Tien, Lam Son... of Quynh Lap, there is a situation where many households illegally built houses on agricultural land, many of which have been used stably. In 2013, the commune made records of 13 households violating and imposed administrative fines. Some households violating such as: Phan Van Hung, Pham Thi Nhuan, Truong Van Dung, Ho Sy Trung, Truong Thi Hieng, Le Ba Thu, Nguyen Phuc Hung... have finished building houses and are living there.

Quynh Phuong Ward (Hoang Mai Town) also has many households building illegal houses, up to now there have been 70 cases, of which about 10 households built permanent houses, the rest are temporary houses. Violations became more common in 2010 and 2011, when the State finished building the Quynh Phuong coastal embankment, many plots of land were left, and people living there (Hong Hai, Tan Hai, Tan Phong hamlets...) occupied and built houses and walls. In 2013, the ward rectified this situation, organizing enforcement of 12 new cases that had just begun to gather materials and build surrounding walls. Currently, Quynh Phuong Ward is making a proposal to the town: For small encroached land plots under 50m2, the adjacent households should pay land use fees to legalize them. For areas larger than 50m2, a dossier should be prepared and submitted to the competent authority for land valuation or land auction to increase revenue for the state budget. Mr. Binh also added: The Ward has prepared a dossier to request the Town to enforce 3 cases: Nguyen Duc Thang, Nguyen Van Hai, Phan Anh Toan.

Illegal construction of houses on agricultural land or hilly land in Hoang Mai town has been going on for many years, showing the laxity in land management by authorities at all levels. To soon restore order in illegal construction, Hoang Mai town needs to find a solution soon, strengthen management, and strictly handle violators.

Article 182 - Decree No. 181/CP on guidelines for the implementation of the Land Law stipulates: Cadastral officers of communes, wards and towns are responsible for regularly inspecting the situation of land use in the locality to promptly detect cases of land encroachment, land occupation, land use failure, land use for the wrong purpose, illegal land use purpose change and other cases of administrative violations in land management and use. Within no more than 1 day from the time of detecting violations, they must report in writing to the Chairman of the People's Committee of the commune, ward or town where the land is located for handling, and at the same time send it to the Department of Natural Resources and Environment.

The Chairman of the People's Committee of the commune, ward or town is responsible for regularly directing the inspection and detection of acts of land encroachment, improper land use, and illegal land use conversion. Within 1 day from the time of detecting a violation or being reported a violation, the inspection must be organized, a record must be made, a decision must be issued to suspend the violation, administratively handle the violation according to authority and request the restoration of the original land use status. If the violator does not comply with the suspension decision, a decision must be issued to enforce the restoration of the original land use status and a written report must be sent to the People's Committee at the next higher level.
