Regime and policies for families of non-commissioned officers and soldiers on active duty

According to Decree No. 88/2011/ND-CP dated September 29, 2011, from November 15, 2011, families and relatives of non-commissioned officers and soldiers on active duty will enjoy a number of preferential regimes and policies from the state as follows:


- Applicable subjects include: biological parents; fathers, mothers-in-law or fathers, mothers-in-law; legal guardians; wife or husband; biological children, legally adopted children of non-commissioned officers and soldiers serving in the army.


- Rights of families and relatives of non-commissioned officers and soldiers on active duty: Students who are biological children or legally adopted children of non-commissioned officers and soldiers are exempted from tuition fees when studying at public and non-public preschools according to the provisions of Decree 49/2010/ND-CP dated May 14, 2010 on tuition exemption and reduction, support for learning costs and the mechanism for collecting and using tuition fees for educational institutions in the national education system from the 2010-2011 school year to the 2014-2015 school year.


In addition, families and relatives of non-commissioned officers and soldiers on active duty are granted emergency hardship allowances in the following cases: accidents, fires, natural disasters leading to house collapse, house drift, house fire or family relocation are granted an allowance of 2 million VND/time; biological parents; fathers, mothers-in-law or fathers, mothers-in-law; legal guardians; wives or husbands; biological children, legally adopted children who are sick for 1 month or more or are treated at a hospital for 7 days or more are granted an allowance of 500,000 VND/time.


The above subsidy regime is not more than twice a year for one subject.


Biological parents; fathers-in-law or mothers-in-law; legal guardians; spouses; biological children or legally adopted children who die or go missing will receive a subsidy of 1 million VND/person.


- The funding source is guaranteed to comply with the provisions of the Budget Law. Those who are subject to the above provisions will no longer enjoy the regime when non-commissioned officers and soldiers stop serving in the army, are sacrificed, die or violate discipline and are stripped of their military titles.


Those who falsify or forge records, depending on the nature and severity of the violation, will be subject to disciplinary action or criminal prosecution and must compensate for damages (if any) according to the provisions of law. This Decree replaces Decree No. 106/2007 dated June 22, 2007 of the Government regulating the regime and policies for families of non-commissioned officers and soldiers on active duty.
