Regime and policies for forces managing and protecting national defense works and military zones
The Government has just issued Decree No. 213/2025/ND-CP dated July 30, 2025 detailing a number of articles of the Law on Management and Protection of National Defense Works and Military Zones.

In particular, the Decree clearly stipulates the regime and policies for agencies, units, and individuals (forces) in the management and protection of national defense works and military zones. Specifically:
Allowance regime for specialized forces performing tasks of managing and protecting national defense works and military zones
The beneficiaries of the allowance include:
a) Specialized force performing the task of managing and protecting defense works and military zones of the Special Group;
b) Forces performing the task of protecting the Ministry of National Defense Command;
c) Specialized forces performing the task of managing and protecting Group I type A defense works that are not sealed or covered.
The above subjects are entitled to a job responsibility allowance of 0.2.
In particular, subjects belonging to the forces specified in a and c who are tasked with preserving national defense works are entitled to a special military allowance of 10%.
Labor day allowance and meal allowance for individuals mobilized to participate in management and protection activities of national defense works and military zones
The Decree stipulates cases of mobilization to participate in management and protection activities of national defense works and military zones, including: Mobilization to overcome natural disasters and fires; mobilization to handle security and order situations affecting the safety and confidentiality of national defense works and military zones.
Labor day allowance and meal allowance for individuals mobilized to participate in activities to protect national defense works and military zones are as follows:
The food allowance is equal to the basic food allowance of non-commissioned officers and infantry soldiers on active duty in the Vietnam People's Army.
Rewarding agencies, organizations and individuals with achievements in participating in management and protection of national defense works and military zones
- Rescue construction when there is a dangerous incident that can affect life and health.
- Contribute resources to the protection, preservation, maintenance and upgrading of defense works and military zones.
- Detect, denounce, and prevent acts of infringement, sabotage, or disclosure of secrets of defense works and military zones.
Compensation for property damage to agencies, organizations and individuals coordinating or mobilized to participate in the management and protection of national defense works and military zones
- Lost, destroyed or damaged property.
- Benefits associated with the use and exploitation of lost or reduced assets.
- Other damages as prescribed by law.
Regimes and policies for people mobilized to participate in management and protection of national defense works and military zones who are sick, have accidents, are injured or die while performing their duties.
The Decree stipulates that people participating in social insurance and health insurance who are sick, have an accident, are injured, or die while performing the task of managing and protecting national defense works and military zones are entitled to benefits according to the provisions of the law on social insurance and health insurance and are paid for the co-payment costs and medical expenses not covered by health insurance.
People who do not participate in health insurance and get sick, have an accident, or are injured while performing their duties of managing and protecting national defense works and military zones will have all medical examination and treatment costs paid.
People who do not participate in social insurance but have an accident that reduces their ability to work according to the conclusion of the Medical Examination Council will be considered for benefits depending on the level of reduced ability to work; if they die, their relatives will receive a death benefit and funeral expenses.
People who are injured or die while performing their duties will be considered for the same benefits and policies as war invalids or will be considered for recognition as martyrs and enjoy other rights as prescribed by law.
The Decree clearly stipulates that during the time participating in the management and protection of national defense works and military zones, mobilized people who do not participate in health insurance, when sick, have an accident or are injured, will be paid all medical examination and treatment costs and receive daily food allowance during the inpatient treatment period until their health is stable and they are discharged from the hospital, as is the case with militiamen.
For
-During the accident treatment period, the employee is entitled to all medical examination and treatment costs and daily meals, including in case of recurrence of the injury until the health is stable and the employee is discharged from the hospital, as for the militia.
- In case of accident leading to death, relatives are entitled to receive death benefits and funeral expenses as for militia and self-defense forces.
The Decree also clearly states: People mobilized to participate in the management and protection of national defense works and military zones are not entitled to medical examination and treatment costs if they are sick, have an accident, or are injured in one of the following cases: Intentionally self-destructing their health; accidents due to reasons unrelated to the performance of duties. In these cases, when they have an accident or die, they are not entitled to benefits.
Decree 213/2025/ND-CP takes effect from September 15, 2025 and replaces Decree No. 04/CP dated January 16, 1995 of the Government promulgating the Regulations on protection of national defense works and military zones.
