Management and use regime of Road Maintenance Fund

The Ministry of Finance and the Ministry of Transport have just issued a Circular230/2012/TTLT-BTC-BGTVTInstructions on management, use, payment and settlement of Road Maintenance Fund.

Expenditures of the Road Maintenance Fund include: Regular maintenance expenses; Periodic repair expenses (including major and medium repairs) of roads; Unscheduled repair expenses (overcoming the consequences of natural disasters, floods, storms or other unusual causes to ensure traffic and traffic safety); Expenses for managing road works carried out by organizations providing public service products for road maintenance management; Expenses for operating vehicle load inspection stations, including: Regular operating expenses, irregular expenses (purchasing and repairing equipment; repairing and upgrading station houses)... This Circular provides guidance on how to establish, divide and assign plans for collecting road use fees per head of road motor vehicles to the Central Fund and Local Funds.

For fees collected from automobiles, the Central Fund Management Board reviews, approves the collection plan and assigns the plan to the implementing units; in which the portion retained for expenses for the fee collection unit according to regulations, the remaining portion for road maintenance management expenses is divided into 65% for the Central Fund and 35% for local Funds; the decision is to divide 35% for each local Fund.

For fees collected from motorbikes, the Local Fund Management Board reviews and approves the collection plan and assigns the plan to the implementing units; in which the remaining portion is for the fee collection unit according to regulations, the remaining portion is for road maintenance management.

Develop a plan to allocate expenses for national highway management and maintenance

Regarding the allocation of expenditure plans, the Circular stipulates that based on the additional level from the central budget assigned by the Ministry of Transport, the amount of fees collected from automobiles (the 65% portion is divided), the national highway maintenance management plan; the Central Fund Management Board shall notify the road maintenance management expenditure plan to the Vietnam Road Administration and the operating expenditure to the Fund Office to prepare a budget allocation plan, report to the Central Fund Management Board for appraisal and approval.

For the Vietnam Road Administration, develop a plan to allocate expenses for national highway management and maintenance to the Road Management Areas and the Department of Transport (for national highways under authorized management) according to regulations and details for each project associated with the road section, route, volume and implementation cost (except for emergency repair projects in step 1).

For projects with a construction period of more than 1 year, the allocation of the annual expenditure plan must be ensured according to the volume and construction time approved in the investment decision; the expenditure plan must not be allocated to repay debts for the volume implemented the previous year but not on the list of plans assigned the previous year (except for the volume of emergency repairs, weak bridges, black spots, potential traffic accident locations and other objective reasons approved by competent authorities for which there is no allocated budget).

Periodic and surprise inspection of the management and use of the Fund

To ensure the proper and effective use of the Road Maintenance Fund, the Ministry of Transport, local Transport Agencies, and the Fund Management Board are responsible for coordinating with the Finance agencies at the same level to conduct periodic and surprise inspections of the management and use of the Road Maintenance Fund.

During the management and inspection process, if any expenditure is found to be not in accordance with the regime or not in accordance with the prescribed content, it must be accounted for and recovered from the Fund; at the same time, the individual who made the decision to make the wrong expenditure must be held responsible according to the provisions of law.
