Preferential treatment for medical staff rotating to lower levels

(Baonghean) - Question: I am a nurse, 40 years old this year. The agency has just decided that I am on the rotation list to go to the lower level. I would like to know the subjects and the regime applied to practitioners during the rotation period?

Reply:On February 20, 2013, the Prime Minister issued Decision No. 14/2013/QD-TTg deciding on the implementation of a limited-term rotation regime for practitioners at medical examination and treatment facilities.

This Decision stipulates the implementation of a fixed-term rotation regime for practitioners at medical examination and treatment facilities from the central level to the provincial level, from the provincial level to the district level and from the district level to the communal level, from areas with no socio-economic difficulties to areas with difficult socio-economic conditions and areas with especially difficult socio-economic conditions.

- Accordingly, Article 2 stipulates the applicable subjects:

This Decision applies to doctors, nurses, midwives, technicians (hereinafter referred to as practitioners) working in public medical examination and treatment facilities.

This Decision does not apply to practitioners at medical examination and treatment facilities of the armed forces.

- Article 3. Subjects exempted from implementing the rotation regime include:

1. Female practitioners who are pregnant or raising children under 36 months old, or male practitioners who are raising children under 36 months old alone.

2. Practitioners who have worked in remote areas or areas with particularly difficult socio-economic conditions for 24 months or more.

3. Practitioners in particularly difficult circumstances: Being the only child in a family with elderly parents; being the person directly caring for elderly or disabled parents who are often sick; having a disabled wife (or husband) who is unable to take care of children; not being in good health to work away from home.

4. The practitioner must be male over 55 years old and female over 50 years old (except in voluntary cases).

5. Other special cases shall be considered and decided by the head of the agency or unit for practitioners under their management.

- Article 7 stipulates: The regime applicable to practitioners during rotation period is:

1. Current salary and allowance regime:

100% of salary, salary-based allowances (excluding professional allowances); Professional allowances, toxic allowances, special allowances; regional allowances (if any) as for practitioners at the place of work. In case the place of rotation implements these allowances at lower levels than the sending unit, the current level will be maintained; Special allowances for medical staff such as: Regular allowances, surgery and procedure allowances, epidemic prevention allowances and night work and overtime (if any) according to regulations; Other benefits such as: Additional income, bonuses (if any).

2. Special regime for practitioners on rotation: Monthly allowance equal to 50% of current salary plus leadership position allowance and seniority allowance beyond the framework (if any); Remuneration for compiling textbooks, teaching and training materials; reporter salary according to the current training and fostering regime for civil servants and public employees when participating in training courses during the rotation period.

3. Priority mode

Practitioners who excellently complete their tasks during their rotation (with a reward decision from the unit where the practitioner rotates) will be given priority for an early salary increase, a change in professional title when meeting the conditions prescribed by law, and will enjoy other rewards as prescribed by the unit.
