Decree regulating the royalty regime in the field of press and publishing, effective from June 1, 2014.

This Decree applies to authors, copyright owners, journalists, reporters, editors, press agencies, publishers and state agencies, organizations and individuals related to press works and publications.

The Decree clearly states that the level of royalties and remuneration paid to authors or copyright owners and those who participate in work related to press works and publications is based on the genre, quality of the work, the level of influence of the work on the economy and society, the level of contribution to the work, the regulations on encouraging the creation of works in this Decree and the regulations of the press agency using the work or according to the contract for using the publication with the publisher. The author's royalty level is not lower than the remuneration level of those who participate in work related to works of the same genre.

Authors of works for children, ethnic minorities, investigative reports; Vietnamese authors writing directly in a foreign language, Kinh authors writing directly in an ethnic minority language, ethnic minorities writing directly in the languages ​​of other ethnic minorities; authors of works produced in difficult or dangerous conditions and other special cases are entitled to higher royalties to encourage creativity.

Works of creative and research types are paid higher royalties than works of translation, adaptation, reformation, conversion, collection, compilation, annotation, anthology and compilation. Authors are entitled to royalties according to the regulations of the agency using the work when the work is used as a collection, anthology, adaptation, reformation, conversion, collection and compilation into a new work or translated into another language. For original works translated into another language for publication in another type of press or another press publication of the same press agency, royalties are paid according to the regulations of each press agency.

Works circulated internally and not for commercial purposes enjoy lower royalties than works of the same genre that are for commercial purposes. The royalty rate is agreed upon by the author or copyright owner and the party using the work.

Also according to the Decree, for co-authored works, the royalty sharing ratio is agreed upon by the authors. For republished press works that cite sources from other press agencies that have agreed to share information according to copyright regulations, the royalty is decided by agreement between the press agencies.

Royalty fund provision

Press agencies shall set up a royalty fund within the prescribed sources. The royalty fund shall be used to pay royalties to authors or copyright owners whose works are used; to pay remuneration and material benefits; to organize activities to encourage creativity; and shall not be used for other purposes.

The Decree clearly states that, no later than 60 days from the date the work is posted or published, the party using the work must pay all royalties to the author or copyright owner according to regulations.

Authors working under contract with press agencies using their works, creating works beyond the assigned quota of the press agency, are entitled to 100% royalties.

People belonging to press agencies using the work to perform work related to the press work beyond the assigned quota will receive 100% of the remuneration.

Maximum coefficient of royalties for printed and electronic newspapers from 10-50

The Decree clearly states that the subjects entitled to royalties and remuneration for printed and electronic press works include: 1- Authors or copyright owners whose works are used by press agencies; 2- Leaders of press agencies, editors and those involved in performing work related to press works; 3- People collecting documents and providing information to serve the creation of press works.

The royalty framework for printed and electronic newspapers is regulated by a maximum coefficient of 10 for news, responses to readers, pictures and photos. For the genres of political commentary, reportage, memoir (one issue), interviews, literary works and research, the maximum coefficient is 30. For the genre of online and Media, the maximum coefficient is 50.

For spoken and visual press works, the maximum coefficient for news and reader responses is 10; for political commentary, reportage, memoir (one issue), interview, literary composition, research, scientific and educational guidance is 30 and for discussion and exchange is 50.

In which, the value of one unit of royalty coefficient is equal to 10% of the basic salary./.
