The Government issued a new Decree on job positions and civil servant payroll.
The Government has just issued Decree No. 62/2020/ND-CP on job positions and civil servant payroll.

The Decree stipulates that agencies and organizations must base their determination of job positions for civil servants on: 1- Functions, tasks, powers, and organizational structure of the agency or organization; 2- Level of complexity, nature, characteristics, and scale of operations; scope and service objects; professional and technical management processes according to regulations of specialized laws.
Job positions are classified by workload; by nature and content of work.
Agencies and organizations under ministries, ministerial-level agencies, agencies under the Government, organizations established by the Government or the Prime Minister that are not public service units, People's Committees of provinces and centrally run cities (ministries, branches, localities) shall, based on the above regulations and guiding documents of competent authorities on job positions, develop job position projects of their agencies and organizations, send them to the agencies and organizations assigned with the task of organizing cadres of ministries, branches, and localities for appraisal and submit them to competent authorities for decision.
Heads of ministries, branches and localities approve job positions in agencies and organizations under their management authority.
2 cases of staff adjustment
The Decree clearly states that the civil servant payroll is determined based on: 1- Job position and workload of each job position; 2- Level of modernization of equipment, working means and application of information technology; 3- Actual use of assigned civil servant payroll; 4- For local agencies and organizations, in addition to the basis specified in points 1, 2, 3 above, it is also necessary to base on population size, natural area, number of administrative units at district and commune levels and characteristics of political security, order and social safety.
Adjustment of civil servant staffing in agencies and organizations is considered in two cases: 1- The agency or organization changes one of the bases specified above; 2- Establishment, reorganization, dissolution of agencies and organizations according to decisions of competent authorities; establishment, dissolution, merger, division, adjustment of administrative boundaries of provincial and district-level units.
Basis for determining civil servant ranks
The Decree also clearly stipulates the basis for determining the structure of civil servant ranks, including: 1- Job position; 2- Level of complexity of work for each job position; 3- Civil servant rank standards corresponding to job position.
The civil servant rank structure of each agency and organization is the percentage of civil servants holding ranks appropriate to their job positions and the level of complexity of the work according to the job positions.
The Minister of Home Affairs provides specific guidance on determining the structure of civil service ranks.
The Government assigns the Minister of Home Affairs to decide on the allocation of civil servant payrolls to each ministry, sector and locality; to decide on the allocation of civil servant payrolls working abroad to ministries, ministerial-level agencies and agencies under the Government after approval by the Prime Minister; to decide on the transfer of civil servant payrolls between ministries, sectors and localities with agencies and organizations specified in Clause 1, Article 21 of this Decree; to decide and manage the number of ranks and structure of civil servant ranks upon request of ministries, sectors and localities.
