Government proposes to retain birth certificates and marriage registrations
Director of the Department of Civil Status, Nationality and Authentication Nguyen Cong Khanh said that there are currently about 10 types of civil status documents, the Ministry of Justice and the Government propose to retain two types of documents: birth certificates and marriage registrations.
The above statement was made by Mr. Khanh on the morning of October 16 at the press conference on judicial work in the third quarter of 2014 of the Ministry of Justice, when answering questions from reporters about the content of not issuing Birth Certificates to children (according to the draft Law on Civil Status), instead issuing Citizen Identification Cards to children (according to the draft Law on Citizen Identification).
Explaining this proposal, Mr. Khanh emphasized the special importance of the above two types of documents for each individual and stated that other types of documents will be kept by the authorities and citizens in need will be issued them upon request.
The Government has issued Official Dispatch No. 179/CP-PL and Official Dispatch No. 368/CP-PL to the National Assembly Standing Committee expressing its view that continuing to issue Birth Certificates to children upon birth registration is necessary, in accordance with the international convention on the rights of children, the Civil Code, etc.; the issuance of Citizen Identification Cards should only be applied to people aged 14 and over.
Also at the press conference, Chief of the Ministry Office - Spokesperson of the Ministry of Justice Tran Tien Dung said that the work of drafting legal documents, commenting on and appraising legal documents has been actively implemented. In the first 9 months of 2014, the Government, Prime Minister, Ministers, and Heads of ministerial-level agencies issued 103/124 documents detailing the implementation of 41 laws and ordinances that have come into effect; there are still 22 documents (17.7%) in arrears. This is the lowest rate of document arrears compared to the same period in other years.
The work of inspecting legal documents has been strengthened by ministries, branches and localities, initially combining the inspection of documents with the work of monitoring law enforcement and controlling administrative procedures.
Conducting the review of legal documents implementing the Constitution, through reviewing 92,140 documents, initially ministries, branches and localities have proposed to amend, supplement, replace, abolish, stop implementing or issue new 292 documents.
In the last months of 2014, the Ministry of Justice continued to promote the implementation of activities to implement the 2013 Constitution; advised and assisted the Advisory Council in appraising draft laws and ordinances directly implementing the Constitution... The Ministry completed the review and made a list of legal documents that need to be abolished, amended, supplemented or newly issued to comply with the 2013 Constitution.
The Ministry of Justice continues to review and reduce administrative procedures, especially in areas directly related to the lives of people and businesses such as tax, customs, land, and construction; strictly implement the control of administrative procedures right from the stage of drafting legal documents. Effectively implement the Law on Handling of Administrative Violations; fully issue documents guiding its implementation, especially the Decree on the database for handling administrative violations./.
