Government holds special meeting on law making

On April 20, under the chairmanship of Prime Minister Nguyen Tan Dung, the Government held a thematic meeting on law making.

Overview of the meeting

There are still many "overdue" documents.

At the meeting, the Government listened to the Ministry of Justice's report on the drafting and submission of draft laws and ordinances of the Government in the first quarter and tasks for the second quarter of 2014.

The Ministry of Justice's report said: In the first quarter of 2014, ministries must submit 10 draft laws to the Government.

Of these, 1 draft law has been submitted by the Government to the Standing Committee of the National Assembly; 1 draft has been commented on by the Government at the regular meeting in February.

During this meeting, the Government also gave opinions on 7 draft laws: Law amending and supplementing a number of articles of the Law on Pharmacy; Law on Management and Use of State Capital in Investment in Production and Business; Law on Investment (amended); Law on Enterprises (amended); Law amending and supplementing a number of articles of the Law on Civil Judgment Enforcement; Law on People's Public Security; Law amending and supplementing a number of articles of the Law on People's Army Officers.

Regarding the development and issuance of documents guiding implementation, according to the program, 90 documents must be issued (of which 58 documents are from 2013, 32 are newly issued). Of these, 46 documents are under the authority of the Ministers. However, the ministries have only made 7/46 documents, and 39 Circulars are outstanding.

The Ministry of Justice stated that ministries and sectors have tried to keep up with the drafting schedule. However, there are still projects that require a delay in submission. The progress in issuing guidance documents is still slow, failing to meet the set schedule and requirements.

Looking back at the work of drafting laws and ordinances in the first quarter, the Prime Minister assessed that ministries and branches have actively implemented them. However, in terms of promulgating sub-law documents, although there has been much progress (in 2013, the number of outstanding documents was the lowest ever), there are still 58 outstanding guiding documents.

The Prime Minister reminded: We are still "working too slowly", there are still many "backlogged" documents.

Emphasize feasibility

The Prime Minister requested that members of the Government need to discuss thoroughly, learn from experience, and do a better job in drafting guidance documents. Accordingly, ministries, branches, and directly the Ministers, need to focus highly on directing this work.

"Comrades must strive so that in the second quarter, in the report on the situation of law making, there will no longer be the sentences 'no change', 'no change yet'," said the Prime Minister.

For draft laws, the Prime Minister requested to closely follow the provisions of the Constitution and the Party's direction in drafting.

In addition, the Prime Minister also directed to ensure conditions such as funding and human resources for the development of legal documents. Accordingly, ministries shall estimate funding for the Ministry of Finance to allocate according to tasks; at the same time, arrange appropriate personnel to perform assigned tasks.

In particular, the Prime Minister emphasized the need to ensure the progress and quality of draft laws. The drafting of legal documents must ensure feasibility. Avoid the situation of drafting documents that do not ensure quality and are "received by public opinion" when soliciting opinions.

With a very practical perspective, the Prime Minister said: "Life is 100% difficult", it is difficult to avoid regulations that are not suitable for this area or that area. Therefore, the Prime Minister requested that the drafting agencies must be "ready to absorb and adjust accordingly".
