Policy to support investment in high-tech projects

(Baonghean) -Resolution No. 106 on a number of preferential policies and investment support for high-tech projects in Nghe An province in the period 2013 - 2020.

Pursuant to the Law on Organization of People's Councils and People's Committees dated November 26, 2003; Pursuant to the Law on State Budget dated December 16, 2002; Pursuant to the Law on High Technology dated November 13, 2008; Considering the proposal of the Provincial People's Committee in Submission No. 8440/TTr-UBND dated November 25, 2013; Based on the Inspection Report of the Economic - Budget Committee and the opinions of the delegates of the Provincial People's Council, the 16th Nghe An Provincial People's Council, 10th session, resolved:

Article 1. Scope of regulation and applicable subjects.

1. Scope of adjustment:

This Resolution stipulates a number of preferential policies and investment support for high-tech projects in Nghe An province in the period 2013 - 2020.

2. Applicable subjects:

a) Domestic and foreign organizations and individuals who are investors in high-tech application projects, high-tech product manufacturing projects, and high-tech agricultural projects (hereinafter referred to as high-tech projects) are granted a Certificate by the Ministry of Science and Technology or the Ministry of Agriculture and Rural Development.

b) Domestic and foreign organizations and individuals who are investors in high-tech product manufacturing projects and high-tech application projects recognized by the Provincial People's Committee.

c) Domestic and foreign organizations and individuals are investors in the Project to build infrastructure for High-Tech Parks and High-Tech Agricultural Parks established by decision of competent state agencies.

Article 2. Incentive and support policies for High-tech Projects granted Certificates by the Ministry of Science and Technology or the Ministry of Agriculture and Rural Development.

1. Regarding investment in infrastructure construction:

a) Site leveling: Investors who use their own capital to level the site within the project fence will be supported by the Provincial People's Committee with a maximum of 50% of the cost based on the design, estimate and actual settlement data inspected and approved by the competent authority, but not exceeding the following levels: 3 billion VND for projects with a total investment of 50 billion to 100 billion VND; 5 billion VND for projects with a total investment of over 100 billion VND to 200 billion VND; 7 billion VND for projects with a total investment of over 200 billion VND.

b) Traffic routes: The province invests in building no more than 7km of traffic routes from the main axis (national highway, provincial road, district road) to the center of concentrated raw material areas such as: tea, coffee, orange, pineapple, banana, grass, sorghum... with an area of ​​100 hectares or more, serving the processing industry in high-tech projects.

c) Power supply: The province commits to supplying power to the project fence or the project's raw material center according to load demand and voltage level.

d) Information technology and telecommunications infrastructure: The province invests in building information technology infrastructure and high-speed Internet lines to the province's concentrated Information Technology Parks.

2. On training and human resource development:

a) Hiring experts: The province will support 30% of the value of the expert hiring contract (each contract is 1 expert) with a term of 6 months or more for the necessary tasks of high-tech projects, but not more than 3 contracts of all types/projects/year. The maximum support level is not more than 150 million VND/contract/year. The support period is not more than 2 years/project.

b) Vocational training support: Investors sign contracts with workers (management, technical, professional) in high-tech projects with a fixed term of 24 months or more and send them for training at vocational training facilities in or outside the province or for training at the investor's production facility, with a vocational certificate or higher, the province will support one-time training costs equivalent to 1.5 basic salary levels/person.

3. Support for water supply:

The lowest price is applied in exploiting and using water from rivers, streams, lakes and dams in the area.

4. Technology and equipment support:

The province provides financial support for the following contents: Technology transfer; investment in equipment and machinery; trial production. The maximum support fund is not more than 30% of the total investment of the above contents and is approved by the Provincial People's Committee but not more than 3 billion VND/high-tech application project, not more than 5 billion VND/high-tech product manufacturing project.

Article 3. Incentive and support policies for high-tech application projects and high-tech product manufacturing projects recognized by the Provincial People's Committee.

1. Support content:

Financial support for investment in application and development of High Technology such as: Technology transfer; investment in equipment and machinery; trial production; training and hiring experts to implement the project.

2. Support level:

Maximum not exceeding 30% of the total investment for the contents in Clause 1 of this Article but not exceeding 3 billion VND/high-tech application project, not exceeding 5 billion VND/high-tech product manufacturing project.

Article 4. Incentive and support policies for investment projects in developing infrastructure of high-tech parks and high-tech agricultural parks.

1. Regarding compensation and site clearance:

The province commits to hand over the clean land to investors. In case the investor advances funds for local compensation or negotiates compensation for land, assets on land and support costs (if any) according to the plan approved by the competent authority, this fund will be refunded by the province at the state unit price within 1-5 years from the date of handover of the land.

2. Regarding leveling the ground within the project fence:

The provincial budget supports 50% of the cost of site clearance based on the design and estimate approved by competent authorities and according to actual settlement data inspected by competent authorities, but not exceeding 300 million VND/ha.

Article 5. Implementation.

Assign the Provincial People's Committee to organize the implementation of this resolution.

Implementation costs: From provincial budget.

Article 6. Entry into force.

This Resolution was passed by the 16th Provincial People's Council, 10th session on December 13, 2013 and takes effect 10 days after the date of passage.
