Allow bail to be posted to keep the violating vehicle

Instead of having their vehicles detained as prescribed, individuals and organizations can pay bail to keep their vehicles.

The Prime Minister has just issued a Decree regulating the management and preservation of exhibits and means of administrative violations that are temporarily seized or confiscated under administrative procedures, effective from November 18, 2013.

Article 14 of this Decree clearly states: Hand over the vehicle that violates administrative regulations to the violating organization or individual for keeping and preservation.

Accordingly, vehicles violating administrative regulations are subject to temporary detention to ensure enforcement of administrative penalty decisions. If the violating organization or individual has the financial capacity to post bail, the violating vehicle may be kept and preserved.

In addition, violating organizations and individuals must present their household registration books or temporary residence books or have a certificate from the agency or unit about their place of work; if the violating organization has a specific and clear operating address confirmed by the People's Committee of the commune, ward or town, and have a place to keep and preserve the vehicle.

When handing over a vehicle to an organization or individual for keeping or preservation, a record must be made. The record must clearly state the name, quantity, weight, characteristics, type, brand, origin, place of keeping, preservation, and condition of the vehicle (if any) and must have the signatures of the organization or individual in violation and the person with authority to temporarily detain. The record is made in two copies, each party keeps one copy.

During the time the violating vehicle is assigned to the organization or individual for keeping and preservation, it will not be allowed to circulate, and the vehicle registration certificate will be temporarily detained to ensure the execution of the penalty decision (except in cases where the violating organization or individual has posted a bail).

Within 10 days from the date of expiration of the penalty decision enforcement period, if the organization or individual fails to comply with the penalty decision, the security deposit amount shall be converted into the penalty amount; in case the security deposit amount is greater than the penalty amount, the remaining amount of the security deposit after deducting the penalty amount shall be returned to the organization or individual placing the security deposit.
