In order to help enterprises in Hanoi grasp the legal provisions on trade defense measures (anti-dumping, anti-subsidy and self-defense measures) to proactively deal with lawsuits in the world market against Vietnamese export goods and protect the legitimate interests of domestic manufacturing industries against foreign goods imported into Vietnam, on October 29, 30, 31, 2013, the Hanoi Department of Industry and Trade organized 3 training programs and seminars on the above contents. Information provided by lecturers from the Competition Management Department shows that currently, Vietnamese enterprises often face anti-dumping and anti-subsidy lawsuits in major markets such as the United States and the EU.

Big market - high risk of lawsuits

The United States has always been a major export market for Vietnam. Up to now, the United States is Vietnam's second largest partner in the world, after China, and is Vietnam's largest trading partner in the Americas. In 2012, the total import-export turnover between Vietnam and the United States reached 24.49 billion USD, of which exports reached 19.66 billion USD and imports reached 4.83 billion USD. The United States is Vietnam's largest consumer market and the 7th largest supplier of goods to the Vietnamese market.

However, the US is a rather sensitive market, if we look back at a series of anti-dumping and anti-subsidy lawsuits on imported goods from many countries, including Vietnam. Since 2000, Vietnamese export enterprises have continuously faced many anti-dumping lawsuits in the US market: Anti-dumping lawsuits on basa and tra fish fillets, anti-dumping lawsuits on frozen black tiger shrimp, anti-dumping lawsuits on PE plastic bags, waterproof rubber shoes, hangers and wind power tower products...

In the first 6 months of 2013, the United States continued to be the largest market importing Vietnamese goods with a total value of nearly 10.9 billion USD, an increase of 17.2% over the same period last year and accounting for 17.4% of the country's total export turnover.

According to lawyer Jonathan Freed of the Trade Pacific PLLC law firm in the United States, businesses exporting goods to this market need to find out which companies in the United States are producing similar products. For example, the chance of Vietnam's coffee and cocoa exports to the United States being investigated for anti-dumping is very low because there are almost no US companies producing these products. The next issue that businesses need to find out is trade data. For example, is the product they are exporting to the United States at the "threshold" that US companies can initiate an investigation?
