National Assembly Chairman: Need to shorten the promotion period for General

On April 16, National Assembly Chairman Nguyen Sinh Hung suggested that specific regulations should be made in the draft Law amending and supplementing a number of articles of the Law on Officers of the Vietnam People's Army in the direction of shortening the promotion period to the rank of General to rejuvenate commanding officers in the army.

Commenting on the above draft law at the 27th session of the National Assembly Standing Committee, National Assembly Chairman Nguyen Sinh Hung emphasized the principle of conferring military ranks: superiors must be higher than subordinates, leaders must be higher than deputies, and equivalent positions will have equivalent military ranks according to the direction of the Politburo.

National Assembly Chairman Nguyen Sinh Hung requested that both the Law on People's Army Officers (amended) and the Law on People's Public Security (amended) must comply with this principle.

"For the Army, units with the Political Commissar model can have the same rank, but other units should not have such regulations," said the National Assembly Chairman.

Regarding the promotion period to the rank of General, the National Assembly Chairman suggested that there should be a regulation to immediately appoint a rank ceiling for those appointed to a position without a suitable rank.

For example, a Lieutenant General elected to the Politburo and appointed as Minister of National Defense will be promoted to General ahead of schedule - the National Assembly Chairman said.

Regarding the issue of officer salaries, the National Assembly Chairman suggested that it is necessary to thoroughly follow the direction of the Politburo, not to specifically stipulate in this law but to create a separate salary scale.

Regarding the unification of military rank ceilings between the Army and the Police, Chairman of the National Assembly's Defense and Security Committee Nguyen Kim Khoa expressed his opinion that we should not compare the appointment of positions and military ranks between the Army and the Police because the Army is organized according to an inter-regional combat model including ensuring the safety of airspace, land, and territory, so it has its own characteristics.

Some other opinions at the meeting said that the draft Law stipulates that some positions with the ceiling rank of General have not yet met the requirements, such as the same group of basic positions but different ceiling ranks, some positions are awarded the rank of Colonel, some positions are awarded the rank of Major General; the same title of Department Director but some Department Directors are awarded the rank of Lieutenant General, some Department Directors are awarded the rank of Major General, causing inconsistencies between the Department and General Department levels; some Department Directors have the same ceiling rank as the General Director, Commander, Political Commissar of the military region, military service and higher than the Deputy General Director; not ensuring the principle that the commander and political commissar have the highest responsibility and authority of the unit.

Some opinions suggested that the draft should clarify the positions that require the rank of General; there is no need to stipulate the rank of General for some units such as: enterprises, public service units. On the other hand, combat units and units directly serving combat must be higher than other units to avoid inappropriate regulations, causing comparison, questions and disagreement within the force.

Regarding salary policy in the Army, the National Assembly Standing Committee agrees with the policy of separating salary from military rank and believes that it is necessary to innovate salary policy in this direction, ensuring that salary is determined according to job position and title, so that the conferment and promotion of military ranks in the armed forces meets the requirements and tasks of military leadership and command, and meets the requirements of tasks in the new situation.

Some opinions also said that some provisions in the draft Law are closely related to the provisions of the Constitution such as: the authority of the National Assembly, the President, the Prime Minister. Therefore, the Drafting Committee needs to study the provisions closely, in accordance with the provisions of the Constitution and in accordance with the tasks and authority of state agencies regarding the organization of the People's Army.

Compared to the previous draft, this draft Law amending and supplementing a number of articles of the Law on Officers of the Vietnam People's Army has a number of new points such as the conferment of military ranks to the rank of general is amended according to the 2013 Constitution and is stipulated in the law, not at a level below the law.

In addition, the draft Law removes the provision that the highest military rank is Major General for General Directors of Type 1 companies. The minimum time limit for promotion from Colonel to Major General is 4 years. The promotion from General to General and above will not have a time limit.

For Hanoi, the highest rank of armed forces commander is Lieutenant General; in Ho Chi Minh City, the highest is Major General. Military commanders of provinces will hold the rank of Lieutenant Colonel; except for 6 provinces and cities: Hai Phong, Da Nang, Can Tho, Thanh Hoa, Nghe An and Dong Nai, who hold the rank of Colonel.
