Swearing at students will result in a fine of 20 million, forcing them to take extra classes will result in a fine of 10 million.

The Ministry of Education and Training has just released a draft Decree on Administrative Penalties for Violations in the Education Sector for public comment. The decree on penalties has proposed many high administrative penalties for regulations on organizing extra classes as well as insulting the dignity and honor of teachers and students.

Specifically, according to Article 8 on violations of regulations on organizing extra classes, organizations will be fined from VND 2,000,000 to VND 3,000,000 for organizing extra classes without ensuring facilities.

For acts of not complying with regulations on public disclosure of information on extra-curricular teaching organizations, a fine of VND 2,000,000 to VND 4,000,000 will be imposed. A fine of VND 3,000,000 to VND 5,000,000 will be imposed on teachers receiving salaries from the salary fund of public service units who organize extra-curricular teaching outside of school.

Fines from 4,000,000 VND to 6,000,000 VND for using tutors who do not meet the prescribed training standards. Fines from 6,000,000 VND to 8,000,000 VND for organizing tutoring in addition to regular classes.

For the act of organizing extra classes at a location other than the licensed location; organizing extra classes for the wrong subjects or with content other than the licensed one, the fine will be from 6,000,000 VND to 8,000,000 VND.

Fines from VND 8,000,000 to VND 10,000,000 for forcing students to take extra classes. Fines from VND 10,000,000 to VND 15,000,000 for organizing extra classes without a license.

The Decree also stipulates additional penalties for violations of the regulations on extra teaching, such as revoking the right to use the extra teaching license from 6 to 12 months for violations of the regulations in Clause 6 of this Article. Suspension of extra teaching activities from 12 to 24 months for violations of the regulations in Clause 8 of this Article...

Article 9 of the decree clearly states that teachers who teach extra classes outside of school without permission from the head of the teacher management agency will be fined from VND 2,000,000 to VND 4,000,000. At the same time, a fine of VND 4,000,000 to VND 5,000,000 will be imposed on those who teach extra classes without meeting the required qualifications. From VND 5,000,000 to VND 6,000,000 will be imposed on those who teach extra classes for primary school students or students who have studied two sessions per day.

Particularly for the act of cutting content in the official general education program to include additional teaching content, or teaching additional content before the content in the official general education program, there will be a fine from 6,000,000 VND to 8,000,000 VND.

The draft will be open for comments until November 25.

Regarding the regulation on insulting the dignity and honor of students, the draft decree stipulates a fine of 10,000,000 VND to 20,000,000 VND for this act.

Fine from 20,000,000 VND to 30,000,000 VND for acts of physical abuse of students.

Along with that, the violating organization or individual is forced to make a public apology.
