In her complaint to Nghe An Newspaper, Ms. Nguyen Thi Hoa said: Since 1983, her family has been assigned by the People's Committee of Nghi Kim commune nearly 4 sao of land for production in Hai field (now hamlet 3, Nghi Kim commune, Vinh city). In 2011, the province approved this land for Truong Son Construction Company to build Bac Vinh Commercial Housing Area. However, according to Ms. Hoa, it is incorrect that her family's name was not on the list of compensation recipients, because up to now, no one has produced on this land. For the above reason, when Truong Son Company leveled the ground, her son, Mr. Nguyen Van Minh, fenced off an area of ​​nearly 1,000 m2 that the family considered to be their field...




Response document No. 445 of Nghi Kim Commune People's Committee does not have the name of Ms. Nguyen Thi Thao.

To resolve this issue, in 2011, Nghi Kim commune authorities held two direct meetings with Mr. Nguyen Van Minh. Thereby, it was determined that this land had previously belonged to Ms. Hoa's family and that her family had cultivated the field for many years. However, since 1988, because her family moved from Nghi Kim to Nghi Phu, no one had cultivated the land anymore. In 1994, implementing Directive 02 of the Provincial Party Committee and Decree 64 of the Government on the issuance of certificates of land use rights for residential land, garden land, and agricultural land, a part of this land was assigned to Ms. Nguyen Thi Thao to cultivate and fulfill her obligations to the State.


Currently, Ms. Thao’s family has received compensation and support from Truong Son Construction Company. During the meetings, Mr. Nguyen Van Minh’s family could not provide any documents or papers to prove the origin of the agricultural land that Mr. Minh was arbitrarily fencing off.


Working with us recently on this issue, Mr. Cao Huy Ty - Chairman of Nghi Kim Commune People's Committee once again affirmed that Ms. Hoa's land claim was baseless, and said: "The commune has worked and responded many times, the project has also been implemented normally, I do not understand why Ms. Hoa's family continues to file a lawsuit". To prove this, Mr. Ty sent us two documents: Report No. 254/BC - UBND, Nghi Kim, dated July 5, 2011 "Regarding the obstruction of construction and works after compensation for agricultural land of Truong Son Construction Investment Joint Stock Company, when implementing the project, Mr. Nguyen Van Minh, fenced off to prevent the construction unit" and Report No. 445/BC - UBND, Nghi Kim, dated November 22, 2011 "Regarding the response to the petition of Ms. Nguyen Thi Hoa, Hamlet 8, Nghi Phu Commune".


Both documents state: "Since 1994, a part of this field has been assigned to Ms. Nguyen Thi Thao to cultivate and fulfill her obligations to the State until it was recovered and she received compensation from Truong Son Company, and the remaining part is used as internal traffic land."


With the above two replies, the Chairman of Nghi Kim Commune said that the commune had been "understanding and reasonable" in resolving the issue of Ms. Hoa's family. However, the surprising thing was that when we asked the commune to show us the original records of the re-granting of the above land to Ms. Nguyen Thi Thao according to Decree 64 of 1994, in the cadastral book of Hamlet 3 and in the land inventory book, plot 470 (Ms. Hoa's previous land plot) did not have Ms. Nguyen Thi Thao's name as in the reply. In addition, the compensation plan of the above project also did not have the name of Ms. Nguyen Thi Thao (Hamlet 3).


Regarding this incident, Mr. Nguyen Ngoc Minh, a commune cadastral officer, asked Mr. Nguyen Duc Thong (former hamlet chief of hamlet 3, now deputy police chief of Nghi Kim commune) to verify. Here, Mr. Thong said he did not know about the case of Ms. Thao being compensated. Nghi Kim commune chairman Mr. Cao Huy Ty explained: "I also do not know why, maybe the commune's judicial officer made a typo"... Currently, the above incident has not yet had a final conclusion from the competent authority, the Vinh City People's Committee.
