On June 21, 2012, after coordinating with the Department of Construction, the People's Committee of Quynh Luu District and the People's Committee of Hoang Mai Town to inspect the legal procedures and field work of the mining and processing area for common construction materials of Hoang Mai Cement Joint Stock Company, the Department of Natural Resources and Environment issued Document No. 1824/STNMT to report to the Provincial People's Committee and responded to Nghe An Newspaper as follows:

Regarding legal documents, Hoang Mai Cement Joint Stock Company is a unit of Vietnam Cement Industry Corporation, granted mining license No. 1099 on October 24, 1995 by the Ministry of Industry, licensed area of ​​144.5 hectares, mine reserves of 125.6 million tons, mining capacity of 1.8 million tons/year, term of 50 years. The investment project to build a cement factory was approved by the Government and the Ministry of Science, Technology & Environment approved the environmental impact assessment (EIA) report in 1996.

Field survey of the mine and processing area: Currently, the company is organizing mineral exploitation with a mining license. According to the company's report, during the mineral exploitation process, the company has classified limestone. For limestone blocks with quality that do not meet the requirements for cement production, they are processed into stone for common construction materials. Currently, the Cement Company has invested in installing 2 common construction stone processing lines with a capacity of 240 m3/hour, of which line 1 has been in operation since June 2011 and line 2 has been in operation since November 2011. At the time of inspection, the company was temporarily suspending stone processing.

The installation of the production line according to the company's report is in accordance with the policy of the Party Committee, the Board of Directors of the Corporation and the Board of Directors of the Company also issued a resolution approving the project to build 2 construction stone processing lines, with a capacity of 120 m3/hour/line. The results of the inspection of exploration documents, technical designs, and environmental impact assessment reports show that the mine area has non-raw stone as lenses, layers of limestone sandwiched with dolomite extending, the thickest place is T1 varying from 20m to 160m, the basic chemical composition is non-raw stone.

According to the technical design summary description in November 1998, the thickness of the clamping layers varies from 3m to 15m, the number of clamps increases gradually towards the South of the mine, the largest clamping mine is cut straight, the thickness varies from 20m to 160m; the thickest place in the East of the mine is currently managed by Hoang Mai Stone Enterprise (under the Vietnam Railway Union); at the same time, the average amount of clamping stone (lime) is calculated to be 75,000 m3/year, in the South of the mine alone, the amount of limestone transferred to the dumping site is an average of 180,000 m3/year. Limestone has average compressive strength, is good for use as a material for building irrigation and traffic, so it can be exploited and utilized. However, the company's EIA report only assessed construction, mining and cement production activities, and did not assess the processing of non-raw stone.

Based on the results of the inspection and comparison with the provisions of the Law on Minerals, the Hoang Mai Cement Company's collection of non-raw stone for processing into common construction stone materials is in accordance with the provisions of the law. However, the company has not yet reported to the competent state management agency; has not yet prepared an additional environmental protection project when installing 2 stone processing lines. In addition, the Hoang Mai Cement Company also organized the sale of stone at a lower price than some other enterprises in the area, which is true and should be considered and handled.

Pursuant to the provisions of the Law on Minerals, the Department of Natural Resources and Environment of Nghe An province recommends that the Provincial People's Committee direct Hoang Mai Cement Company to report the results of mineral exploitation and processing to the competent management agency in accordance with the provisions of the 2010 Law on Minerals; at the same time, fully perform tax obligations to the State when processing stones for construction materials; establish a supplementary project on environmental protection for non-raw stone processing activities; report to the Ministry of Natural Resources and Environment, the General Department of Geology and Minerals for guidance and handling of mineral exploitation licenses in accordance with the provisions of the Law on Minerals; direct local price management agencies to review the selling price of common construction stones in Quynh Luu area to request Hoang Mai Cement Company to adjust in the direction of ensuring fair competition in accordance with the Law on Competition among enterprises producing materials in the area.
