The above information was announced by the Director of the Provincial Civil Judgment Enforcement Department at a working session with the monitoring delegation of the Provincial People's Council's Legal Committee on the results of the enforcement of cases violating economic management order on the afternoon of October 13.

At the meeting, the representative of the THADS Department said that some cases with evidence of firecrackers, the Court had decided to temporarily suspend for a long time, so they are currently pending and must be preserved pending the court's settlement results.
Currently, there is a large amount of evidence of firecrackers being kept in the warehouses of the THADS branches because the prosecution agencies have not yet reached a consensus on the preservation of evidence of firecrackers.
In 2017, the Provincial Department of Civil Judgment Enforcement handled 16,760 cases, of which 3,886 cases were transferred from the previous year, 12,894 cases were newly handled, and 90% of the cases have been completed. From January 2015 to June 2017, the Department of Civil Judgment Enforcement received 86 judgments related to violations of economic management order, accordingly, it issued 138 decisions/more than 3.8 billion VND for enforcement of court fees, confiscation, and handling of evidence. In addition, the Provincial Department of Civil Judgment Enforcement also handled 2 cases transferred from other places and 2 cases that had been decided to be handled but not yet completely handled. |
However, the evidence storekeepers of the THADS agencies do not have expertise in preserving explosives and flammable substances, so there are many potential risks of fire and explosion.
For example, at the Vinh City Fire Prevention and Control Department, there are 7 cases with 90kg of firecrackers that have not been processed; at the Dien Chau District Fire Prevention and Control Department, there are 18 cases related to firecrackers with evidence that have not been processed.
Currently, the whole province has 16 THADS units that do not have warehouses to preserve evidence, so the execution of judgments faces many difficulties.
Ms. Hoang Thu Trang - Director of the Provincial Department of Judicial Enforcement also made recommendations to the monitoring delegation on a number of issues such as: Proposing the Provincial People's Council to issue a resolution on a special policy to support funding for Judicial Enforcement agencies in the province; proposing the Provincial People's Court to direct courts at all levels to apply measures to block the assets of litigants so that the enforcement agency can completely handle related evidence in accordance with regulations; proposing the district-level agency to provide operating funds for the Judicial Enforcement Steering Committee...

The members of the monitoring delegation requested the THADS Department to compile and provide additional data related to the handling of cases violating economic order for the monitoring delegation to synthesize, such as: the effectiveness of handling cases violating economic management order other than firecrackers; specific regulations on the destruction of evidence such as firecrackers to ensure no impact on the environment; the situation of inspection and supervision of judgment enforcement at district-level units, etc.
Ms. Thai Thi An Chung - Deputy Head of the Provincial People's Council's Legal Committee requested the Department of Civil Judgment Enforcement to continue to pay attention to recommending competent authorities to build warehouses for preserving evidence; strengthen inspection and examination work at the grassroots level; coordinate well with localities, relevant departments and branches in enforcing cases of violations of economic management order.
The recommendations of the Provincial Youth Union's THADS Department will be received and submitted to competent authorities.
