What wrong did Mr. Nguyen Huu Tin do?
At the time he was Vice Chairman in charge of urban areas of the Ho Chi Minh City People's Committee, in June 2015, Mr. Tin was said to have signed a decision to hand over public land at 15 Thi Sach (Ben Nghe Ward, District 1) to Bac Nam 79 Company, with Vu Nhom as director. The content required the company not to convert, transfer, lease, mortgage, or contribute capital using land use rights.
Half a year later, the city issued a document recognizing Bac Nam 79 Company as the investor of the Commercial - Service - Apartment Complex project at the above address and instructed the company to contact relevant departments to carry out procedures to implement the project.
In May 2016, the Ho Chi Minh City People's Committee allowed the investor to build an 18-storey building for commercial, service, hotel, office, apartment purposes... After that, the City People's Committee decided to allow Bac Nam 79 Company to change the land use purpose at the above address, completing the process of land allocation to this company.
This decision of Ho Chi Minh City is not in accordance with the Prime Minister's Regulation No. 09/2007 on the rearrangement and handling of State-owned real estate. The land was sold by appointment without bidding. Mr. Tin signed the decision to allocate the land based on the proposal of the Director of the Department of Natural Resources and Environment at that time, Dao Anh Kiet.
In addition to the case involving Vu Nhom, Mr. Tin and Mr. Kiet were also prosecuted in another case related to the leasing of a 6,000 m2 prime land plot at 2-4-6 Hai Ba Trung (District 1) without auction.
