Ensure the regime for officials to retire early
(Baonghean) - Implementing Decree 26/2015/ND-CP of the Government stipulating the regime and policies for cadres who are not eligible for re-election or re-appointment to positions and titles according to their terms, Nghe An Social Insurance in particular and Nghe An province in general have proactively and flexibly deployed, resolved correctly, fully and promptly the regime and policies for the subjects.
Mr. Sam Ngoc Toan, 60 years old, is the former Chairman of the People's Committee of Chau Quang Commune (Quy Hop). Before becoming Deputy Chief of the Commune Police in 1992, Mr. Toan had 15 years of experience as a border guard (from 1975 to 1990). Before the Commune Party Congress for the 2015-2020 term held in June 2015, Mr. Toan was past the age limit for re-election but still had nearly 2 years to go before he was 60 years old and could retire under the regime. At the beginning of 2015, Mr. Toan was quite worried about his pension and salary benefits. However, his concern was resolved when Decree 26/2015/ND-CP dated March 9, 2015 of the Government was issued, regulating the regime and policies for cadres who do not meet the age requirements for re-election or re-appointment to hold positions and titles according to their terms in agencies of the Communist Party of Vietnam, the State, and socio-political organizations at the Central level, in provinces and centrally-run cities; in districts, towns, provincial cities, and in communes, wards, and towns.

Mr. Toan said: “With peace of mind, I wrote a voluntary early retirement application to the personnel management agency. I have been entitled to retirement benefits according to the provisions of the law on social insurance and have enjoyed a number of additional benefits such as not having my pension rate deducted due to early retirement; receiving a salary subsidy for each year of early retirement, and support for insurance premiums... The total amount of subsidy until I received my pension book was 72 million VND. I personally found that the agencies, departments, and social insurance agencies resolved the matter quickly and very satisfactorily.”
Along with Mr. Toan, according to information from the Provincial Social Insurance: Up to now, 238/239 subjects have had their benefits resolved promptly according to Decree 26/2015/ND-CP. Mr. Nguyen Quang Quyet - Head of Regime Department, Provincial Social Insurance said: Immediately after receiving Official Letter No. 3624/BHXH-CSXH dated September 22, 2015 of Vietnam Social Insurance on instructions for implementing the social insurance regime according to Decree 26, Nghe An Social Insurance promptly issued Document No. 3238 dated September 30, 2015 to the Professional Departments, Social Insurance of districts, towns and cities to thoroughly study Decree 26/2015/ND-CP, Instructions No. 35 and 36-HD/BTCTW of the Central Organizing Committee, Official Letter No. 3624/BHXH-CSXH and assigned Social Insurance of districts, towns and cities to receive dossiers in the province, and at the same time sent a document to the Provincial Party Committee's Organization Committee, the Department of Home Affairs, the Standing Committees of district, city and town Party Committees in the province on coordinating to resolve the regime according to Decree 26/ND-CP for subjects in accordance with regulations.
Agencies, units, People's Committees of districts, towns and cities in Nghe An province have promptly disseminated and guided the preparation of dossiers; checked and approved dossiers, decided on early retirement, and retirement waiting for retirement age for those who meet the conditions according to their authority or proposed competent authorities to decide and sent a written request for implementation of regimes and policies to the Department of Home Affairs, the Provincial Party Committee's Organization Board, and the Department of Finance. The Social Insurance Agency has proactively worked with the Department of Home Affairs when units made lists to submit; the Department of Home Affairs has conducted appraisal and synthesis to submit to the Provincial People's Committee to make a list and estimate the budget to send to the Ministry of Finance. This list is also sent to the Provincial Social Insurance Agency, thereby, the Provincial Social Insurance Agency has proactively and continuously urged the Social Insurance agencies of districts/towns/cities to urge the labor-using units to complete the dossiers in order to pay regimes and policies in accordance with regulations after being approved by competent authorities. When there are completed dossiers submitted, the Provincial Social Insurance Agency prioritizes immediate settlement.

By August 2016, Nghe An Social Insurance had basically received the documents and resolved the policies for the subjects approved by the competent authority in a timely manner, creating excitement for the beneficiaries of the social insurance policy. Up to now, there is only one case that has not been resolved, that is Ms. Nguyen Thi Soa, former Vice Chairwoman of Nghi Huong Ward People's Council (Cua Lo Town). Ms. Soa previously worked at the Fuel Company, then retired and joined the ward. To enjoy the policy, it is necessary to add up the working time at both agencies. However, the work records of the previous period are not complete, need to be supplemented to add up the time and the provincial Social Insurance is continuing to help Ms. Soa do this.
And not only the provincial Social Insurance agency, implementing Decree 26, departments, localities and units in the province have actively implemented it. The Provincial Party Committee's Organizing Committee has proactively surveyed and classified cadres in advance, so it has advised the Provincial Party Committee's Standing Committee to issue many documents directing Party committees at all levels to implement and advise the province to resolve each specific case. The resolution of this policy is very flexible, such as applying Decree 108/2014/CP on the policy of streamlining payroll to ensure policies for cadres, especially commune-level cadres; using the province's salary reform source to pay for those who are less than 24 months away from retirement age with an amount of more than 1 billion VND. Thanks to that, Nghe An is one of the few localities that effectively resolves difficulties in implementing Decree 26.
