Registration of telecommunication subscriber information is mandatory.
The Government has issued Decree 25/2011/ND-CPdetailing the implementation of a number of articles of the Telecommunications Law, which stipulates that from June 1, 2011, subscribers must have clear responsibilities in registering, storing and using telecommunications subscriber information.
The Decree clearly stipulates that when entering into a contract, if the subscriber is an individual, he/she is responsible for providing the telecommunications enterprise with information such as full name; date of birth; number, date of issue, and place of issue of the identity card for Vietnamese citizens or passport for foreign citizens.
For subscribers who are organizations, when entering into a contract, the telecommunications subscriber is responsible for providing the telecommunications enterprise with information such as the name of the organization; address of operation; number and date of establishment decision; date of issuance of the organization's business registration certificate; ID card number or passport number of the representative signing the contract to use telecommunications services...
Regulations on telecommunications subscriber information registration points must meet four conditions. One is to have a specific transaction location. Two is to have sufficient equipment to store and transfer subscriber information according to regulations of the Ministry of Information and Communications. Three is to have transaction staff trained by telecommunications enterprises on the process and procedures for registering subscriber information. Four is to meet other conditions according to regulations of the Ministry of Information and Communications.
In addition, the owner of the subscriber information registration point is responsible for storing registered subscriber information according to the regulations of the Ministry of Information and Communications and providing it to competent state management agencies upon request.
The above Decree takes effect from June 1.
