To help readers better understand the 2013 Land Law, as well as the province's preparations for implementation, Nghe An Newspaper interviewed Mr. Vo Duy Viet - Provincial Party Committee member, Director of the Department of Natural Resources and Environment about these issues.
PV:Could you tell us the advantages of the 2013 Land Law?
Mr. Vo Duy Viet:It can be said that the 2013 Land Law is an important event marking innovations in land policies to meet the requirements of socio-economic development in the period of accelerating industrialization and modernization of the country, meeting the requirements of international integration and ensuring the maintenance of political and social stability of the country.

The 2013 Land Law has many new provisions, generalizing over 9 groups of issues to create a favorable legal corridor to improve the efficiency of land use, while resolving existing problems and difficulties arising in practice. The 2013 Land Law establishes more specifically the responsibilities and powers of the State and land users, pays attention to land quality; continues to perfect land law policies in the agricultural sector.
The 2013 Land Law also strengthens the operation of land relations according to market mechanisms. In addition, the 2013 Land Law also pays more attention to ensuring land use rights for women, the poor, and ethnic minorities; establishing equality in land access; enhancing publicity, transparency and democracy in land management and use to minimize complaints among the people.
PV:On January 22, 2014, the Prime Minister issued Directive No. 01/CT-TTg on the implementation of the 2013 Land Law. So in Nghe An, how is Directive No. 01 of the Prime Minister implemented, sir?
Mr. Vo Duy Viet:In order to promptly implement Directive No. 01/CT-TTg dated January 22, 2014 of the Prime Minister on the implementation of the 2013 Land Law in the province, based on the advice of the Department of Natural Resources and Environment, on March 24, 2014, the Provincial People's Committee issued Decision No. 1077/QD-UBND promulgating the Plan to implement Directive No. 01/CT-TTg on the implementation of the 2013 Land Law in the province. In the above plan, the Provincial People's Committee assigned departments, branches and People's Committees at all levels to fully perform the tasks required by the Prime Minister in Directive No. 01/CT-TTg. These are:
- It is necessary to prepare well the conditions for implementing the 2013 Land Law in the province, focusing on propaganda and dissemination of land law; drafting legal documents; organizing the apparatus and staff in charge of land management.
- Organize the implementation of the 2013 Land Law in the province, focusing on planning and land use planning; land allocation, land lease, land use purpose conversion; land recovery, compensation, support and resettlement; basic land investigation, land registration, issuance of land use right certificates, house ownership certificates and other assets attached to land, construction of land information system, land database; land valuation; inspection and supervision of compliance with land laws and settlement of complaints and denunciations about land management and use.
PV:Sir, has Nghe An completed the construction of a system of legal documents related to the implementation of the Land Law? And what is the focus of the system of legal documents that has been built?
Mr. Vo Duy Viet:Since the 2013 Land Law was passed by the National Assembly, the Department of Natural Resources and Environment has organized research on all provisions of the 2013 Land Law, on that basis, proposed to the Provincial People's Committee a list of legal documents on land under the authority of the Provincial People's Committee to issue.

In the legal documents on land under the authority of the Provincial People's Committee, the Department of Natural Resources and Environment pays special attention to documents regulating land recovery, compensation, support, and resettlement when the State recovers land; land allocation, land lease, change of land use purpose, issuance of Land Use Right Certificates, House Ownership Certificates and other assets attached to land for households and individuals.
PV:According to Decree No. 43/2014/ND-CP of the Government on guiding the implementation of a number of articles of the Land Law, from July 1, 2014, land use right registration offices under districts, cities and towns will be under the direct management of the Department of Industry and Trade. So, sir, has this work been carried out in our province or not?
Mr. Vo Duy Viet:According to the provisions of Article 5, Decree No. 43/2014/ND-CP of the Government, the Land Registration Office is a public service unit under the Department of Natural Resources and Environment established or reorganized by the Provincial People's Committee on the basis of merging the Land Use Right Registration Office under the Department of Natural Resources and Environment and the existing Land Use Right Registration Offices under the Department of Natural Resources and Environment in the locality. The Land Registration Office has branches at district-level units. The Land Registration Office must be established or reorganized before December 31, 2015. During the period when it has not been established or reorganized, the established Land Use Right Registration Office shall continue to operate according to the assigned functions and tasks. The Ministry of Natural Resources and Environment shall preside over and coordinate with the Ministry of Home Affairs and the Ministry of Finance to specify the organizational structure, tasks and operating mechanism of the Land Registration Office.
Regarding the reorganization of the land use registration office system in the province, the Provincial People's Committee has assigned the Department of Natural Resources and Environment to complete the project to perfect the organization and staff of land management before July 1, 2014. However, up to now, because the Ministry of Natural Resources and Environment, the Ministry of Home Affairs, and the Ministry of Finance have not issued a Circular guiding the implementation, the Department of Natural Resources and Environment has not been able to complete the project according to the assigned schedule.
Since the functions and tasks of the Land Registration Office system are basically unchanged, and most of the staff in the Land Registration Office system are not disrupted, the reorganization of the land use right registration office system will not greatly affect the implementation of assigned functions and tasks. In the long term, when the "One-level" Land Registration Office model is in operation, the implementation of land registration and other assets attached to land; construction, management, updating, and unified adjustment of cadastral records and land databases; land statistics and inventories; and provision of land information according to regulations to organizations and individuals in need will be more convenient and professional.
PV:In order for the 2013 Land Law to be implemented effectively, what specific steps will our province take in the coming time?
Mr. Vo Duy Viet:In order to organize the implementation of the 2013 Land Law to achieve high results as required by the Government, in the coming time, in our province, the Provincial People's Committee will give priority to issuing full legal documents on land under the authority of the Provincial People's Committee to create a complete legal corridor for land management and use in the province; direct departments, branches and People's Committees at all levels to seriously perform the tasks set out by the Provincial People's Committee in the Plan to implement Directive No. 01/CT-TTg on the implementation of the 2013 Land Law in the province; in the process of directing the implementation of the 2013 Land Law in the province, if any problems arise, they will promptly report to the Ministry of Natural Resources and Environment for guidance before organizing the implementation...
