Promoting decentralization in state administrative agencies in Nghe An province
The implementation of the Project to promote decentralization in state administrative agencies in the province aims to clearly define the tasks, powers, authorities and responsibilities of each level.
Implementing Resolution No. 04/NQ-CP dated January 10, 2022 of the Government on promoting decentralization and delegation of power in state management, aiming to clearly define the tasks and powers, competences and responsibilities of each level, contributing to building a democratic, professional, modern state administration that operates effectively and efficiently, serving the people and businesses. Nghe An Provincial People's Committee develops and promulgates a Project to promote decentralization in state administrative agencies in Nghe An province.

The implementation of the Project to promote decentralization in state administrative agencies in the province aims to clearly define the tasks, powers, authorities and responsibilities of each level; of the Provincial People's Committee with the Departments, branches and localities, contributing to building a democratic, professional, modern state administration that operates effectively and efficiently and serves the people and businesses. At the same time, improve the effectiveness and efficiency of state management; ensure the leading role and unified management of the Provincial People's Committee; strengthen the powers, responsibilities and positivity, proactiveness and creativity of all levels and branches. Minimize the mechanism of agreement, acceptance, giving opinions or approval at higher levels.
About the content of hierarchy:
- In the field of Industry and Trade, the Provincial People's Committee delegated the Department of Industry and Trade to announce the List of locations for organizing trade fairs and exhibitions and priority areas for organizing trade fairs and exhibitions in the province in the following year. The Department of Industry and Trade delegated the District-level Economic/Infrastructure Economic Division to guide and inspect supermarket traders in implementing standards and classifying class 3 supermarkets; instruct supermarket traders in developing and implementing regulations for supermarkets and trade centers; and approve the regulations of class 3 supermarkets.
- In the field of education and training, the Provincial People's Committee delegated the Department of Education and Training to directly manage the finances of public high schools, Hoa Sen Kindergarten, Nghe An Continuing Education - Vocational Guidance Center and Nghe An Continuing Education Center No. 2. Establish external assessment teams to recognize schools that meet national standards according to regulations.
- In the field of construction, the Provincial People's Committee delegates authority to the District People's Committee on the shared use of technical infrastructure works according to regulations. The Provincial People's Committee delegates authority to the District and Commune People's Committees on drainage management and wastewater treatment in the area under its management according to regulations.
- In the field of transport, the Provincial People's Committee delegates the authority to the Department of Transport and the District People's Committees to liquidate road traffic infrastructure assets under the management of the province as prescribed in Point b, Clause 2, Article 24 of Decree No. 44/2024/ND-CP dated April 24, 2024 of the Government. Handling of road traffic infrastructure assets in case of loss or destruction under the management of the province is prescribed in Point b, Clause 2, Article 25 of Decree No. 44/2024/ND-CP dated April 24, 2024 of the Government.
- In the field of Labor, Invalids and Social Affairs, the Provincial People's Committee delegates to the Department of Labor, Invalids and Social Affairs the approval of the salary and remuneration fund, the previous year's bonus fund, and the planned salary and remuneration fund for managers of single-member limited liability companies owned by the Provincial People's Committee.
- In the field of agriculture and rural development, the Provincial People's Committee delegates to the District People's Committee the responsibility to appraise and approve projects and production linkage plans under national target programs (except for content 2 of sub-project 2, under project 3 of the National Target Program on socio-economic development in ethnic minority and mountainous areas for the period 2021 - 2030, phase I: from 2021 - 2025) with the scope of linkage implementation within a district, town or city according to the allocated capital source.
To implement decentralization, the Provincial People's Committee sets out 6 tasks and solutions including:
1. Strengthen information and propaganda work to create consensus throughout the political system;
2. Focus on perfecting regulations to implement decentralization;
3. Innovation of monitoring and post-inspection mechanisms goes hand in hand with decentralization of state management authority;
4. Improve capacity and ensure resources for implementation;
5. Review the organizational structure and human resources to implement decentralization;
6. Monitor, evaluate and implement reporting regime.
The Provincial People's Committee requests that the Departments, branches and sectors with decentralized content under their management proactively advise and propose to the Provincial People's Committee to issue decisions to implement decentralization. The decentralized agencies are responsible before the law for the implementation of decentralization. For decentralized content that changes regulations on administrative procedures or is directly related to the activities of individuals, organizations and enterprises, they must publicly announce the administrative processes and procedures according to regulations.
Annually, the Departments and branches conduct inspections of the implementation results of tasks assigned to the district and commune levels under their management; at the same time, advise on the establishment of interdisciplinary inspection teams to inspect the tasks assigned by the Provincial People's Committee to the Departments and branches; thereby promoting the achieved results, promptly correcting and overcoming shortcomings and limitations; on that basis, advise the Provincial People's Committee to adjust, supplement or report to competent authorities to adjust and supplement accordingly.
During the process of decentralization, the Departments, branches, sectors, and District People's Committees are responsible for explaining and handling issues arising in the management field. Regularly monitor, evaluate, and periodically report on the implementation of decentralization; promptly detect and adjust inappropriate issues or revoke the decentralized authority if the actual implementation does not achieve the set results...
