The annual land use plan at the district level is an important basis for land allocation, lease, permission to change land use purposes; land recovery for projects and works... Mr. Nguyen Van Chat - Head of Land Management Department, Department of Natural Resources and Environment said that determining land use planning as the top priority content that needs to be implemented immediately after the 2013 Land Law takes effect, on August 1, 2014, at the online conference of the industry, the Department of Natural Resources and Environment requested the People's Committees of districts, cities and towns to consider this as a key task for the last months of 2014 to organize the preparation of land use plans for 2015. However, through monitoring, most districts, cities and towns have not paid due attention to the preparation of annual land use plans. On August 25, 2014, the Department of Natural Resources and Environment requested the Provincial People's Committee to issue a document directing the People's Committees of districts, cities and towns to urgently complete related documents for appraisal.
On September 3, 2014, the Provincial People's Committee issued Official Letter No. 6385/UBND.DC on the implementation of land use planning to departments, branches, sectors and People's Committees of districts, cities and towns. In particular, it requires departments, branches and sectors to compile lists of works and projects using land in 2015; for People's Committees of districts, cities and towns, urgently direct relevant units to coordinate with consulting units to develop land use plans for 2015 of their localities according to the guidance of the Ministry of Natural Resources and Environment in Circular No. 29/2014/TT-BTN & MT; completion time, required before October 15. In addition, the Department of Natural Resources and Environment is assigned to guide relevant units on arising problems; Advise the Provincial People's Committee to establish a Council for appraisal of planning and land use plans of the province to appraise the 2015 district-level land use plan to submit to the Provincial People's Council at the year-end meeting according to regulations.

Race against time
The schedule for receiving and appraising the 2015 land use plan dossiers of districts, cities and towns has been extended by the provincial Appraisal Council until November 15, 2014. According to the Vinh City People's Committee, up to now, the 2015 land use plan dossiers have been basically completed, and the Summary Explanatory Report is being finalized. According to Ms. Nguyen Thi Minh Hanh - Specialist of the Department of Natural Resources and Environment, when the province directed the establishment of the 2015 land use plan, the city raised the issue with the consulting unit, the Land Resources Assessment Center (a unit under the Ministry of Natural Resources and Environment). However, because this unit quoted an estimate too high, up to 4.8 billion VND for the establishment of the 2015 land use plan and adjustment of the land use plan to 2020; therefore, the city leaders assigned the Department of Natural Resources and Environment to implement.
Based on the content of Circular 29 of the Ministry of Natural Resources and Environment, the city has directed its affiliated units and agencies located in the area to report on land use needs; in addition, review constructions and projects using land... to establish a land use plan for 2015 to submit to the Provincial Appraisal Council. "Actually, the appraisal of the city's 2015 land use plan must be completed in mid-October. However, partly due to the urgent time, this is a new content, implemented for the first time, so it is inevitable that it is confusing and has not been completed on schedule. However, up to this point, everything has been basically completed. The city will ensure the required time of the Provincial Appraisal Council on November 8..." - Ms. Nguyen Thi Minh Hanh said.
In Quy Hop district, according to Ms. Le Thi Duc - Specialist of the Department of Natural Resources and Environment, because land use planning is a new job, while the staff is few and the capacity is limited, when starting the work, there are many difficulties. Therefore, the district invited a consulting unit, Hanoi Agricultural Science Consulting and Services Company Limited I (under the University of Agriculture I) to carry out the work with a total budget of approximately 300 million VND. The Department of Natural Resources and Environment is responsible for acting as an intermediary, connecting the consulting unit to work with agencies and units in the area to collect data, records, land use needs... to make a land use plan for 2015. This has been done since the beginning of September. However, because Quy Hop has its own characteristics, many business units operating in the field of minerals, the records and related licenses of these units are not guaranteed, some units have expired licenses... Therefore, when submitting to the Provincial Appraisal Council, it is not qualified; For the above types of enterprises, they must be included in a separate list. After receiving instructions and comments from the Appraisal Council, the consulting unit revised and supplemented the dossier and has basically completed it at this point.
Currently, the work of land use planning in 2015 is being focused on speeding up and making efforts to complete, however, according to Mr. Nguyen Van Chat - Head of Land Management Department, Department of Natural Resources and Environment, "we are not really satisfied with the progress of implementation". Mr. Chat is concerned: The provisions of the Land Law are very strict, not only the Provincial Appraisal Council appraises, but also must be approved by the Provincial People's Council. Only then will the Provincial People's Committee officially approve. And the deadline for approving the land use plan in 2015 must be implemented before December 30, 2014. The annual land use planning is extremely important. The land use planning dossier must ensure quality, while the year's time is almost up. One worrying thing is that in the land use planning, districts, cities and towns must organize a thorough review, not to miss any construction items or projects using land. If not ensured, there will be congestion in the implementation process...
