Proposal to abolish the Certificate of house ownership
The Ministry of Construction proposed to amend a number of points in the current Housing Law.
On the morning of May 23, at the Conference summarizing the implementation of the Housing Law and the Real Estate Business Law, Mr. Nguyen Manh Ha - Director of the Department of Housing and Real Estate Market Management said that to suit actual conditions, the Ministry of Construction proposed to amend a number of points in the current Housing Law.
In order to avoid overlapping with the Land Law, the revised Housing Law is expected to remove regulations on granting certificates of house ownership. Instead, it will add regulations related to the recognition of house ownership, regulations on ownership of individual houses, ownership of apartment buildings, etc.
Regarding housing development, it is expected to abolish regulations on housing design standards and leave it to the Government to provide guidance appropriate to each period. At the same time, additional regulations will be added such as: forms of construction of social housing for sale, subjects eligible to buy, hire-purchase social housing, selection of social housing investors, incentive mechanisms, management of rental prices, purchase prices, hire-purchase, etc.
Regarding finance for housing development, it is expected to stipulate additional contents on the establishment of housing development funds in localities, on the establishment of housing savings funds...
Regarding housing transactions, the Ministry of Construction plans to add some more forms of housing transactions such as: transferring housing purchase and sale contracts, contributing capital with housing, and mortgaging future housing.
In addition, the Ministry of Construction also proposed to amend regulations related to Vietnamese people residing abroad, foreign organizations and individuals. Accordingly, it is expected to supplement regulations allowing Vietnamese people living abroad to receive land use rights transfers to build houses like domestic individuals.
For foreign organizations and individuals, the regulations expand the subjects and conditions for home ownership, expand the types of homes that can be owned, expand the right to buy homes from only being able to buy apartments to being able to buy both villas and individual houses...
According to the report of the Ministry of Construction, compared to 1999, the housing area of the whole country has doubled (from more than 709 million m2 to about 1.6 billion m2), the average housing area per capita has also doubled (from 9.68 m2 to 19 m2).
Currently, nationwide there are about 3,700 housing projects and new urban areas that have been and are being invested in and built on an area of 90,100 hectares.
As of the end of 2009 (when the authority to issue home ownership certificates was transferred to the Department of Natural Resources and Environment), the whole country had issued more than 1.2 million home ownership certificates, but the number of outstanding certificates was still quite large./.
