Proposal to pilot granting the right to choose to use car license plates through auction

The draft Resolution stipulates the pilot granting of the right to choose according to the need to use car license plates through auction, including: the starting price of the license plate put up for auction; the case of selling to the only person participating in the auction; the rights and obligations of the agency, organization, individual (hereinafter referred to as the person) winning the auction; the use of revenue from the license plate auction.

According to the draft, the license plates selected for auction are white background car license plates with black letters and numbers in the unregistered license plate warehouse that the Registration Authority plans to issue new ones every month, quarter, 6 months or 1 year. License plates issued to vehicles purchased from the State budget, military vehicles used for defense purposes, vehicles of military enterprises doing business, vehicles of foreign business organizations, diplomatic missions, representative offices of international organizations and foreigners working in such agencies and organizations operating in Vietnam will not be auctioned.

The subjects eligible to participate in the auction are organizations, businesses, and individuals who are allowed to participate in the license plate auction of the locality where the headquarters is located (for organizations and businesses) or where the permanent residence is registered (for individuals).

Regarding the auction organization, the draft proposes that the Public Security of provinces and centrally-run cities organize license plate auctions according to the vehicle registration and management hierarchy.

Regarding the auction form, the Ministry of Public Security assigned the provincial-level Public Security to sign a contract to hire an Asset Auction Organization with an online auction website to organize online auctions.

In addition, the draft also clearly states that the determination of starting price is specifically regulated as follows:

Region 1 (including: Hanoi, Ho Chi Minh City): Gkđ = Glp x 2

Region 2 (including the remaining localities): Gkđ = Glp x 10

(Gkđ: Starting price of 01 license plate to be auctioned, unit is Vietnamese Dong; Glp: Highest registration fee currently applied locally).

The auction winner has the right to sign a contract with the auction organizer to establish the right to the auction winning license plate; to use the auction winning license plate; when transferring the vehicle, the auction winner has the right to keep the license plate to register another vehicle under his/her ownership (the license plate follows the person); when changing the permanent residence address to another province or centrally-run city, the auction winner does not have to return the auction winning license plate.

Manage auction winning license plates

According to the draft, auction winning license plates will only be issued to those who have registered to participate in the auction and won the auction.

The auction winning license plate is managed by the Registration Authority and is only issued when the auction winner completes the registration procedures according to vehicle registration regulations (when the auction winner has not completed the registration procedures, he/she will only be issued a Certificate of Right to Use the Auction Winning License Plate).

The vehicle registration authority has the right to revoke the auction winning license plate when the license plate is used in violation of the law (vehicles with auction winning license plates that violate the law will be confiscated according to regulations).

The proceeds from the license plate auction, after deducting the auction organization costs according to regulations, will be divided into 70% for the central budget and 30% for the local budget.
