Conditions for exploiting aquatic and marine products outside Vietnam's waters

From August 10, 2012, Decree 53/2012/ND-CP on amending and supplementing a number of articles of the Decrees on the fisheries sector comes into effect.

Accordingly, organizations and individuals exploiting aquatic resources outside Vietnam's waters, in addition to meeting all the conditions prescribed in Decree 33/2010/ND-CP such as having enough crew members; being registered and inspected; having crew insurance;..., Decree 53/2012/ND-CP amends the regulation that they must have a fishing vessel crew book or a fishing vessel crew professional certificate.

For organizations and individuals sending fishing vessels to exploit in the waters of other countries or territories, they must meet the conditions prescribed for fishing vessels, crew members, and people working on fishing vessels and the following conditions: Having a fisheries exploitation cooperation contract with organizations and individuals of a country or maritime territory, approved by the competent authority of that country or maritime territory or according to the content of the Fisheries Cooperation Agreement between the country or maritime territory and the Socialist Republic of Vietnam.

Crew members on board must have ordinary passports; on board or in the same group of vessels, there must be at least 1 person who knows English or the common language of the country or territory where the fishing vessel is operating; and must meet other conditions as prescribed by the laws of the host country (if any).

In addition to Decree 53/2012/ND-CP on amending and supplementing a number of articles of Decrees on the fisheries sector taking effect, this August, a number of other policies will also take effect, such as: Policy on establishing public service units; Professional responsibility allowances for 4 subjects: Enforcement Officers, Examiners and Enforcement Secretaries working at civil enforcement agencies and civil enforcement management agencies under the Ministry of Justice, notaries working at Notary Offices; A number of preferential regimes for the Coast Guard; Decree on sanctioning administrative violations in the field of fire prevention and fighting; List of equipment supported to reduce post-harvest losses; Business travel allowances for officials on short-term business trips abroad./.
