Party Charter (written in 1929, approved at the Party Founding Conference on February 3, 1930)

This is the first Charter of the Party written in 1929 and approved at the Party's founding conference on February 3, 1930. It was then revised and supplemented many times at the Party's National Congresses.

COMMUNIST PARTY STATUTE

I- Party Name: Indochina Communist Party

II- Party members

a) Anyone who accepts the program and statutes of the Communist International and of the Party, joins a Party cell and works, obeys all resolutions of the International and of the Party, and pays membership dues is eligible to join the Party.

b) When a new party member joins the party, he/she must be accepted by the party cell and must have approval from the next superior.

c) Factory workers[1]must be introduced by a former party member and accepted by the factory party cell.

d) Farmers, craftsmen and intellectuals must have two former party members to introduce them.

Attention:

1. Party members must be responsible for the people they recommend.

2. Party members from one place to another must report in advance and join and work for the local party committee.

III- How to organize

A- The Communist Party is organized according to democratic centralism, which means:

1. All party levels are elected by party member conferences.

2. Subordinates must report to superiors.

3. Lower-level Party committees must acknowledge and properly implement resolutions of higher levels.

B- In secret situations, when necessary, the superior agency has the right to appoint a subordinate agency.

IV- Organizational system

A - Each factory, trading house, village, street, barracks, etc., if it has three or more party members, establishes a party cell. The party cell has a command committee. The committee is elected by the entire party cell.

B- The headquarters (countryside) has a general command committee.

C- District committees (in provinces) and regional committees (in cities, plantation areas, mining areas) have district or regional committees in command, which are elected by delegates from the district or regional conference.

D- Provincial or municipal ministries (Hanoi, Hai Phong, Vinh, etc.), or special ministries (mines, plantations) have provincial, municipal, or special command committees. These committees are elected by the conference of delegates of the special provincial or municipal ministries.

E- Regional Party Committee[2]North, Central, South Vietnam, Cambodia, and Laos have regional command committees, which are elected by delegates from regional conferences.

H- Central Committee: Elected by the Indochina Party congress delegates.

From the district level up, each committee elects a standing committee to work daily.

V- Discipline

The responsibility of Party members and Party committees is to maintain Party discipline. If they do not comply with Party resolutions, or commit what the Party considers to be mistakes, the Party committee will use its rules to punish them by criticizing them, dissolving members or the entire Party committee, temporarily preventing them from doing important Party work, or expelling them temporarily or permanently. The resolution of expulsion must be posted in the Party report.

VI- Finance

A- The budget of the Party Committees at all levels comes from Party fees, donations and allowances from the above agencies.

B- Monthly allowance determined by the central government, unemployment or poverty[3]then be exempted.
