(Baonghean) - In the 190 articles of the draft revised Land Law that was recently discussed at the meeting of the National Assembly Standing Committee, there are up to 10 contents with different opinions, including the issue of determining the principle of land valuation. Instead of stipulating: The State determines land prices according to the principle of "close to market prices", the Drafting Committee proposed to adjust: The State determines land prices according to the principle of "in accordance with the market". The majority of delegates agreed with this plan but requested to clarify what is "in accordance with the market".
Reality in Nghe An over the years shows that there are many very complicated issues surrounding land valuation. The Provincial People's Committee approves the land price framework once a year, but the appraisal time takes nearly half a year. When the approval decision is made, the land price is already outdated compared to the market price, and the effective time is only 6 months. Waiting for the new price to be approved next year, the process will repeat itself, nothing will change. If the State keeps "running" after market fluctuations to determine land prices, the compensation price will always have a large gap compared to the market price, so people rarely accept it. This is the main reason why many projects are stuck in the compensation and site clearance stage.
The fluctuation of land prices in the market is deeply rooted in speculation. An agricultural land, sometimes abandoned land, but when a road is opened or a project is implemented, the land price immediately skyrockets dozens of times because speculators have poured money into buying the land. When land prices are pushed up by speculators, it is very difficult for the State to determine the land price to compensate the people. Since the policy of compensating enterprises according to the price agreed with the people, the compensation level according to the State's price has become more difficult for the people to accept because it is always lower than the compensation price of enterprises.
The draft revised Land Law stipulates: The State determines land prices every five years according to the principle of "in accordance with the market". To implement this provision, it is necessary to create a stable land price ceiling in the market for at least a five-year cycle. To have a stable land market, corruption and land speculation must be prevented. As long as corruption and land speculation continue, land prices will fluctuate, and land price fevers are inevitable. When land speculators still manipulate the market, the State cannot determine land prices but can only "follow" land prices to cope. To manage and use land effectively, amending the law is not enough, but more importantly, it is necessary to combat corruption and land speculation.
