State-owned enterprises must publicly disclose their financial information on the enterprise's website, in publications, and through popular propaganda methods such as radio, television, and newspapers.

This is the content provided in the draft Circular Guiding the disclosure of financial information of enterprises according to the provisions of Decree No.61/2013/ND-CPJune 25, 2013 of the Government.

Specifically, enterprises must publicly disclose their audited annual financial statements no later than 10 days from the date the independent auditing organization signs the audit report. The deadline for public disclosure of annual financial statements is no more than 90 days from the end of the fiscal year.

At the same time, enterprises must prepare Annual Reports no later than 90 days from the end of the fiscal year. Financial information in the Annual Financial Information Report must be consistent with the audited annual Financial Reports.

According to the draft, information disclosure to the public must be done on the enterprise's website and/or on publications and popular propaganda methods through radio, television, and newspapers.

The Chairman of the Board of Members of the company is responsible for publicizing the financial information of the enterprise.

According to the draft, every year, the owner must publicly disclose the updated List of enterprises placed under special supervision and enterprises removed from the list of special supervision.

Businesses must set up a website to publicize financial information.

According to the Ministry of Finance, enterprises that do not have a website must set up a website within 6 months from the effective date of this regulation. The website must have a separate section on publicizing the enterprise's financial information, including all the prescribed contents.

Information disclosure entities must notify the Ministry of Finance and publicize the website address and any changes related to this address within 3 working days from the date of completion of the website establishment or the date of change in the website address.

In case an enterprise does not have sufficient conditions to operate an electronic information page within 6 months from the effective date of this regulation, it must register with the Ministry of Finance and the owner to publicly disclose the information content specified on the electronic information page of the Ministry of Finance and the owner.

In addition, the Ministry of Finance also requires enterprises to disclose financial information to owners and financial management agencies, to creditors and investors, and to disclose financial information to employees.

Organizations and individuals who violate the provisions of law on public disclosure of financial information of state-owned enterprises and enterprises with state capital shall, depending on the nature and severity of the violation, be subject to disciplinary action, administrative sanctions or criminal prosecution; if causing damage, they must compensate according to the provisions of law.
