National Assembly delegation gives comments on draft Criminal Procedure Code (amended)

(Baonghean.vn) - On the morning of September 24, the Provincial National Assembly Delegation held a Conference to collect comments on the draft Criminal Procedure Code (amended). Comrade Pham Van Tan - Head of the Provincial National Assembly Delegation chaired the conference.

At the meeting, the majority of delegates agreed that amending a number of articles in the Criminal Procedure Code is necessary so that the agencies: police, courts, prosecutors and lawyers can maximize their professional activities in the process of working. Basically, the provisions of the Draft Revised Penal Code are consistent with the Party's guidelines, policies and guidelines; demonstrate humanity, increase benevolence in criminal handling policies, overcome shortcomings and limitations in the fight against and prevention of crime, and in the implementation of the current Penal Code. However, there are still a number of provisions that need to be further studied, revised and improved.

Accordingly, many opinions of delegates said that: Article 13 on the principle of "presumption of innocence" in the draft is still general, contradictory, and does not meet the requirements of concretizing the Constitution. To ensure human rights, citizen rights, and improve the quality of litigation in trials, many opinions proposed to amend as follows: "When there is insufficient and cannot clarify the basis for accusation and conviction according to the order and procedures prescribed by this Code, the agency or person with the authority to conduct the proceedings must conclude that the arrested person, the person in custody, the suspect or defendant is not guilty".
