The Provincial National Assembly Delegation collects comments on the Housing Law Project
(Baonghean.vn) - On the morning of October 7, the Provincial National Assembly Delegation held a conference to collect comments on the Draft Law on Housing (amended). Comrade Pham Van Tan, Provincial Party Committee member, Head of the Provincial National Assembly Delegation chaired the Conference.
The Housing Law Project (amended) consists of 8 chapters and 178 articles and will be submitted to the National Assembly for approval at the 8th session. At the conference, giving comments on the Law Project, the representative of the Department of Construction said that the Draft Law has not clearly affirmed the role of the State in the housing market and social housing investment, and proposed to stipulate that the State is responsible for investing and building social housing.
Regarding public housing, opinions suggested that there was no need to classify central public housing and local public housing; concerns were raised that the subjects eligible to rent public housing are teachers, doctors, and medical staff assigned to work in remote communes, areas with particularly difficult socio-economic conditions, border areas, and islands, which would face financial difficulties during implementation.

Regarding land use rights and home ownership rights, delegates suggested that it is necessary to clearly define these two rights, because these are two completely different rights and to resolve the case where one plot of land has one construction or many constructions with multiple owners.
Regarding the Social Housing Development Fund: the establishment of the Social Housing Development Fund has been stipulated in the Housing Law 2005, however, mobilizing capital for this Fund is very difficult and in reality in Nghe An and some other provinces and cities it has not been implemented, so it is proposed not to include the regulation on the establishment of this Fund in the Draft Law.
Delegates proposed to base on the age of use according to the level of the building or periodic reports on the status of the apartment building (by the investor, owner, apartment building management board, local authorities), to invite a competent independent unit to assess the quality of the building before deciding to demolish it. Comments on Article 15 on the Local Housing Development Program and Plan: propose to add regulations on responsibilities in investigating, surveying, and counting the housing needs of the people before developing the local housing development program and plan. In Article 101 on the Apartment Building Conference, propose to add regulations on the time of organizing the Apartment Building Conference.
