Yesterday, November 20, the National Assembly (NA) voted to pass 7 laws, including 6 amended and supplemented laws. Regarding the Law on Tax Administration (amended), 92.57% of deputies voted to pass it.

Accordingly, enterprises importing goods as supplies and raw materials for the production of export goods are still entitled to keep the maximum tax payment period of 275 days from the date of customs declaration registration if they meet the following conditions: having a production facility for export goods in Vietnam; having export and import activities for at least two consecutive years up to the date of customs declaration registration without committing acts of commercial fraud, tax evasion, overdue tax debt, late payment fees, or fines. In addition, enterprises must meet additional conditions such as: complying with the law on accounting and statistics; making payments through banks in accordance with the law.

In addition, the law also stipulates other cases where tax must be paid before customs clearance, goods release or must be guaranteed by a credit institution. In particular, in cases where taxpayers are late in paying tax after 90 days, they will have to pay late payment fees at the rate of 0.07%/day and be forced to enforce tax administrative decisions.

With the Electricity Law (amended), the National Assembly agreed that from July 1, 2013, electricity prices will be implemented according to the market mechanism with State regulation in accordance with the development level of the electricity market. The State will implement a reasonable retail electricity price structure for customer groups and will support retail electricity prices for living purposes for poor households and social policy households according to criteria prescribed by the Prime Minister. The Ministry of Industry and Trade will preside over and coordinate with the Ministry of Finance to develop a price framework for the average retail electricity price, price adjustment mechanism and retail electricity price structure for submission to the Prime Minister for decision.

The law also clearly states: the adjustment of retail electricity prices must be carried out publicly and transparently regarding changes in the constituent elements related to price adjustment. The State uses measures to stabilize electricity prices in accordance with the provisions of the law on prices. The electricity generation price under a fixed-term electricity purchase contract and the wholesale electricity price are agreed upon by the electricity units but must not exceed the approved electricity generation price and wholesale electricity price frameworks.

Regarding electricity prices in rural, mountainous, border, island and non-grid areas, the Electricity Law (amended) this time clearly states: Provincial People's Committees shall decide in accordance with the mechanism for supporting retail electricity prices for domestic purposes in these areas. Other types of electricity prices shall be developed by relevant electricity units, then submitted to the Provincial People's Committees for decision according to the principle of ensuring adequate compensation for costs and reasonable profits for the electricity units based on consultation with the electricity regulatory agency.

According to the plan, in the last 3 days of the session, the National Assembly will continue to vote to pass a number of draft laws such as the Law on Grassroots Mediation; the Law on National Defense and Security Education; the Law on Anti-Terrorism, etc.
