Business 'cooperates' with hospital director, patient loses 10 billion VND
After the joint venture project between BMS Medical Technology JSC and the former Director of Bach Mai Hospital, the patient suffered a loss of more than 10 billion VND.
According to the indictment of the Supreme People's Procuracy, Mr. Pham Duc Tuan is the legal representative, sitting in the position of Chairman of the Board of Directors of BMS Medical Technology Joint Stock Company (BMS Company).
Contributing 50 billion VND, equivalent to 62.5% of charter capital, Mr. Tuan is the person who operates and directs all activities of the company.
When he learned that Bach Mai Hospital had a policy of developing surgery, around May 2016, Mr. Tuan met Mr. Nguyen Quoc Anh (then Director of Bach Mai Hospital) to discuss cooperation in providing robot systems.surgical supportfor hospital
Mr. Tuan introduced BMS Company as the distributor of the Rosa Robot system supporting cranial nerve surgery and the Mako Robot supporting knee surgery and proposed to supply and sell these two systems for 39 billion VND for the Rosa Robot and 44 billion VND for the Mako Robot to Bach Mai Hospital.

However, Mr. Quoc Anh did not agree because the hospital did not have investment capital and the procedure for proposing approval from the Ministry of Health was complicated, requiring a bidding process.
Furthermore, because these are new treatment methods and techniques, their effectiveness has not been evaluated, and whether or not patients have received treatment.
Taking advantage of position and power to do wrong
At this time, Mr. Quoc Anh suggested that Mr. Tuan make a joint venture project to install the machine at Bach Mai Hospital. The procedures and authority will be decided by Bach Mai Hospital, and the machine price only needs a price appraisal certificate and BMS Company is responsible for contacting the price appraisal unit.
After discussion, the two sides reached an agreement that BMS Company would not sell robot systems to Bach Mai Hospital but would join a joint venture to install robot systems to support surgery at Bach Mai Hospital, with the equipment price set by Mr. Tuan.
After agreeing to let BMS Company be a partner in the project, Mr. Quoc Anh did not consult the Party Committee, Board of Directors and Hospital Union to agree on the policy of making a joint venture project, selecting partners and equipment types.
During the project implementation process, there was no decision to approve the project, no approval from the Equipment and Supplies Department to appraise the equipment price, no document proposing the installation of the machine from the Neurosurgery Department for the Rosa Robot...
But the former Director of Bach Mai Hospital assigned and verbally instructed the Deputy Director in charge of economics and the Finance and Accounting Department to work with BMS Company, propose related procedures, submit the project and joint venture contract for Mr. Quoc Anh to sign and implement.
Regarding the value of the robot systems, Mr. Quoc Anh and Mr. Tuan agreed in advance that the Rosa Robot is 39 billion VND and the Mako Robot is 44 billion VND according to the equipment price given by Mr. Tuan.
Mr. Quoc Anh asked Mr. Tuan to introduce a valuation unit and assign Deputy Director of the hospital Nguyen Ngoc Hien to sign related procedures so that the valuation company can issue a valuation certificate and legalize the equipment price...
According to the indictment, during the process of implementing the project and signing joint venture and association contracts at Bach Mai Hospital, Mr. Quoc Anh and other defendants took advantage of their functions, duties and powers to perform in violation of the provisions of the law.
The accusation is that the Chairman of the Board of Directors of BMS Company gave Mr. Quoc Anh 400 million VND and 10,000 USD.
In this case, the consequence was determined to be increased treatment costs, causing damage to the patient of more than 10 billion VND.
