Simplify administrative procedures on conditions to ensure fire safety

Instead of having to apply for a Certificate of eligibility for fire prevention and fighting (PCCC), individuals and organizations now only need to notify in writing of their commitment to ensuring fire safety conditions and, at the same time, send along documents and papers proving that they fully meet these conditions.

This is one of the contents of Decree No. 46/2012/ND-CP amending and supplementing a number of articles of Decree No. 35/2003/ND-CP detailing the implementation of a number of articles of the Fire Prevention and Fighting Law and Decree No. 130/2006/ND-CP regulating the compulsory fire and explosion insurance regime. Thus, instead of having to carry out procedures for granting a Fire Prevention and Fighting Eligibility Certificate, from July 15, 2012, vehicle owners and facility owners only need to have a written notice of commitment to ensure fire safety conditions along with accompanying supporting documents to be able to operate immediately without waiting for a response from the Fire Prevention and Fighting Police Department.

Subjects covered by Decree No. 46/2012/ND-CP include: Housing, hotels, offices, office buildings for rent with height of 7 floors or more; Facilities producing and processing petroleum, liquefied petroleum gas and flammable and explosive chemicals, of all sizes; Facilities producing, processing, supplying, preserving and using industrial explosives; Petroleum warehouses with total capacity of 500m3 or more, liquefied petroleum gas warehouses with total gas weight of 600kg or more; Petroleum and liquefied petroleum gas stores.

A permanent or semi-permanent market with a total business area of ​​1,200m2 or more or with 300 or more business households, a shopping mall, supermarket, or department store with a total stall area of ​​300m2 or more or a total volume of 1,000m3 or more.

Thermal power plants with capacity of 100MW or more, hydropower plants with capacity of 20MW or more, transformer stations with voltage of 220KV or more.

Motor vehicles with special requirements for ensuring fire prevention and fighting safety such as ships and trains specialized in transporting passengers, gasoline, flammable liquids, flammable gases, explosives, and chemicals with fire and explosion hazards that are newly manufactured or converted.
