Draft Land Law: Term of agricultural land allocation is 50 years

To encourage farmers to be more attached to their land and feel secure in investing in production, in the draft amendment to the Land Law, the Ministry has proposed to stipulate the land allocation period within the land use limit for households and individuals to 50 years and apply it uniformly to all types of agricultural land.
Specifically, the draft Law clearly stipulates: "The term of agricultural land allocation for households and individuals to use is 50 years. When the term expires, the land user will continue to be allocated land by the State if he/she has a need to continue using it, complies with land laws during the use process and the use of the land is consistent with the approved land use plan.
The term for leasing agricultural land for households and individuals is no more than 50 years.
In addition, the draft stipulates the term of land allocation and land lease for economic organizations for use in agricultural, forestry, aquaculture and salt production; economic organizations, households and individuals to use land as premises for construction of production and business facilities; economic organizations to implement investment projects; Vietnamese people residing abroad, foreign organizations and individuals, joint venture economic organizations to implement investment projects in Vietnam are considered and decided on the basis of investment projects or applications for land allocation and land lease, but not exceeding 50 years; for projects with large investment capital but slow capital recovery, investment projects in areas with difficult socio-economic conditions, areas with especially difficult socio-economic conditions that require a longer term, the term of land allocation and land lease is not more than 70 years.
Agricultural land allocation limit
Regarding the limit on agricultural land allocation, in Article 112, the draft Law clearly states: The limit on allocation of land for annual crop cultivation, aquaculture, and salt production to each household and individual is no more than 03 hectares for each type of land.
The limit on land allocation for perennial crops for each household or individual is no more than 10 hectares for communes, wards and towns in the plains and no more than 30 hectares for communes, wards and towns in the midlands and mountainous areas.
At the same time, the draft clearly stipulates the land allocation limit for each household and individual not exceeding 30 hectares for protective forest land and production forest land.
If a household or individual is allocated many types of land including land for growing annual crops, aquaculture land, and salt-making land, the total land allocation limit shall not exceed 05 hectares.
In case a household or individual is allocated additional land for perennial crops, the limit for perennial crop land is no more than 05 hectares for communes, wards and towns in the plains; and no more than 25 hectares for communes, wards and towns in the midlands and mountainous areas. In case a household or individual is allocated additional production forest land, the total limit for production forest land allocation is no more than 25 hectares.
In addition, in Article 113, the draft stipulates that the limit for receiving the transfer of agricultural land use rights of households and individuals shall not exceed 10 times the limit for allocating agricultural land to households and individuals, and the Government shall specify it in accordance with the characteristics of each region and each period, creating conditions for the process of land accumulation and concentration to form large commodity production areas in agriculture.
