Draft regulations on scholarship and training cost reimbursement
According to the draft decree regulating the reimbursement of scholarships and training costs that has just been announced, students of college, university, master's and doctoral education programs who receive scholarships and training costs from the state budget or foreign funding under an agreement signed with the Vietnamese government but do not comply with the state's job assignment after graduation will have to reimburse the training costs.
This Decree applies to learners of domestic training programs under programs, plans, projects, and schemes of agencies and organizations whose training costs are funded by the state budget; learners of overseas training programs under programs, plans, projects, and agreements whose training costs are funded by the state budget.
After graduating from college or university, students must comply with state work assignments twice the time they are entitled to receive training expenses; this time is 2.5 times for master's and doctoral degrees.
Trainees who have not completed the required working time as prescribed above must compensate for expenses according to the formula: (Compensation cost equals the training cost granted/working time under the State's assignment calculated in rounded months) x (working time under the State's assignment calculated in rounded months - working time after being assigned calculated in rounded months).
In case the learner fails to comply with the state's work assignment within 12 months from the date of being recognized as good, the learner must reimburse 100% of the training costs allocated from the state budget.
The time for reimbursement must be no later than 45 days from the date of receipt of the decision of the competent authority.
In case of failure to perform the obligation to compensate, the competent authority shall decide not to resolve the regimes and policies and shall have the right to initiate a lawsuit according to the provisions of law.
