For a long time, illegal racing has become a social problem, causing traffic disorder in many localities, especially in the two big cities of Hanoi and Ho Chi Minh City. To rectify this situation, one of the proposed solutions is to increase the administrative penalty for illegal racing to create a deterrent effect.
Accordingly, in the Draft Decree on administrative sanctions for violations in the field of road and railway traffic of the Ministry of Transport, the penalty for illegal racing has been specifically mentioned.
Specifically, a fine of 1-2 million VND will be imposed for one of the following acts: gathering to cheer, inciting the act of driving at a speed exceeding the prescribed speed, weaving, swerving, chasing each other on the road or illegal racing; bicycle racing, motorbike racing, cyclo racing, animal-drawn vehicle racing, or illegal animal racing on the road.
Fines of 4-6 million VND for those who encourage or incite illegal racing and obstruct or resist law enforcement officers. Fines of 10-20 million VND for those who illegally race motorbikes, scooters, or electric scooters. Fines of 20-30 million VND for those who illegally race cars.
In addition to being fined, violators will also be subject to the following additional penalties: Illegal bicycle racing, motorized bicycle racing, cyclo racing, animal-drawn racing, and animal-riding racing on the road will have their vehicles confiscated (except for animals being pulled or ridden). In cases of illegal motorcycle, moped, electric bicycle, or car racing, car, motorcycle, moped, electric bicycle, or bicycle racing, and those who resist law enforcement officers will have their driving licenses revoked for 24 months and their vehicles confiscated.
Bicycle racing will also be severely punished.
The draft also stipulates a fine of 5-7 million VND for acts such as: letting go of both hands while driving; using feet to control the vehicle; sitting on one side to control the vehicle; lying on the saddle to control the vehicle; changing drivers while the vehicle is running; driving the vehicle in a zigzag or swerving manner on urban and suburban roads; driving a two-wheeled vehicle on one wheel, or a three-wheeled vehicle on two wheels; driving a group of 2 or more vehicles exceeding the prescribed speed limit...
In addition, the Ministry of Transport also proposed that motorbike owners will be fined from 100,000 to 400,000 VND; car owners will be fined from 2 to 8 million VND if they do not complete the procedures to change the ownership after being bought, sold, gifted, or inherited; do not buy or pay fees for vehicles when participating in traffic according to regulations.
Fines from 300,000 to 1 million VND shall be imposed on subjects committing one of the following violations: Installing windshields and door glass on vehicles that are not safety glass; Arbitrarily changing the paint color of the vehicle that is not the same as the paint color stated on the Vehicle Registration Certificate.
Fines from 800,000 to 2.4 million VND for violations of one of the following acts: Arbitrarily re-engraving the chassis number, engine number; Erasing, repairing or falsifying vehicle registration documents; Arbitrarily changing the frame, engine, shape, size, and characteristics of the vehicle; Making false declarations or using fake papers and documents to re-issue license plates and vehicle registration certificates.
In addition, the fines for some common violations such as running red lights, driving in the wrong lane, driving with a blood alcohol concentration exceeding the prescribed limit... have also been adjusted to increase./.
