Some views and goals

The Party Central Committee has a unified viewpoint that land belongs to the entire people and is managed by the State as the representative owner. The State exercises ownership rights through deciding on land use planning and plans; land recovery, land allocation, land lease, recognition of land use rights, permission to change land use purposes and regulations on land use duration; deciding on land prices; deciding on policies to regulate the value added from land not created by land users.

The State reclaims land for use in defense and security purposes, serving national interests, public interests and socio-economic development projects in accordance with the law, ensuring fairness, publicity, transparency and accountability.

Land management and use must ensure the common interests of all people; People are given conditions to access and use land fairly, effectively and sustainably.

Land use rights are a special type of property and commodity but are not ownership rights; land use rights and assets attached to land are protected by law. Land users have the rights and obligations to use land according to the provisions of law.

Regarding a number of issues raised by public opinion and the People in recent times, the Central Executive Committee also clearly affirmed its viewpoint: The State does not recognize the reclaiming of land that has been assigned by the State to others for use in the process of implementing land policies and laws; does not raise the issue of readjusting agricultural land assigned to households and individuals; has policies so that agricultural land is used with the highest efficiency.

6 groups of tasks and solutions

The Party Central Committee has identified six groups of specific tasks and solutions. The focus is on amending and supplementing the 2013 Land Law by 2023 and other relevant laws, ensuring consistency and unity, meeting new development requirements; innovating and improving the quality of planning, land use plans, and land use plans made at the national, provincial and district levels.

Complete regulations on land allocation, land lease, land use purpose conversion; regulations on compensation, support, resettlement, land recovery to implement socio-economic development projects for national and public interests; land price determination mechanism; land finance mechanism and policies, legal regulations related to the real estate market; mechanisms and policies on agricultural land management and use; develop legal regulations on multi-purpose land management and use.

Accordingly, land allocation and leasing are mainly through land use rights auctions and bidding for projects using land; there is a mechanism to handle violations of regulations on land allocation and leasing, especially those related to land use rights auctions and bidding for projects using land.

Compensation, support and resettlement must ensure publicity, transparency and harmonize the interests of the State, people whose land is recovered and investors according to the provisions of the Constitution and law.

Land acquisition must comply with the Constitution and the provisions of the Land Law, but compensation, support and resettlement must go one step ahead. There must be specific regulations on compensation, support and resettlement to avoid the situation where people have no place to live after land acquisition, ensuring that the lives of people whose land is acquired must be equal to or better than their old place of residence.

Regarding land prices, abolish the land price framework; have a mechanism and method for determining land prices, an agency responsible for determining and deciding on land prices, monitoring and inspection...; have an effective mechanism to improve the quality of land valuation work, the independence of the land valuation council, the capacity of land valuation consultancy organizations, the capacity and ethics of valuers; supplement regulations to ensure publicity and transparency.

Regarding the real estate market, promote the commercialization of land use rights; build a real estate market information system linked to land information; have policies to encourage the development of the land use rights market, especially the agricultural land lease market. Have a mechanism to ensure the healthy development of the real estate market; strictly control and overcome land speculation.

Focus investment resources, direct resolutely and enhance the responsibility of central agencies and local authorities in handling existing problems and obstacles related to land originating from state-owned agricultural and forestry farms; land of production facilities and public service units with large populations that have been relocated from the centers of large cities; conduct auctions of land use rights when rearranging state-owned headquarters and workplaces to switch to economic development purposes; land types used for multiple purposes; resolve residential land and production land for ethnic minorities according to land use planning and plans.

Promote administrative reform and digital transformation in the field of land management and use; complete the database and national land information system, ensure centralized and unified management and operation from the central to local levels; improve the capacity of state management of land. Innovate and strengthen inspection, examination, supervision and handling of violations; prevent and combat corruption and negativity in land management and use. Strengthen the leadership of the Party, promote the role of the Vietnam Fatherland Front; socio-political organizations and the People in land management and use.
