These are the opinions of some delegates on the draft Law amending and supplementing a number of articles of the Law on Emulation and Commendation.
On the morning of April 18, the National Assembly's Committee on Social Affairs continued its fifth plenary session, listening to and giving opinions on the examination of the draft Law amending and supplementing a number of articles of the Law on Emulation and Commendation.
The Law on Emulation and Commendation was passed by the 4th session of the 11th National Assembly on November 26, 2003 and took effect on July 1, 2004. Of the 103 articles of the current Law on Emulation and Commendation, this draft amended and supplemented Law will amend and supplement 44 articles from Chapters 1 to 4, focusing on amending and supplementing the system of standards for emulation titles and forms of commendation.
During the review process, members of the National Assembly's Committee on Social Affairs agreed on the need to amend and supplement the Law on Emulation and Commendation to overcome shortcomings and limitations in current regulations and continue to innovate emulation and commendation work.
Delegates focused their opinions on amending the principles of rewards, improving the standards of some emulation titles and reward forms, and adding some authorities, time and procedures for considering emulation titles and reward forms.
Regarding the content of amendments and supplements to the standards of emulation titles and forms of commendation, delegates said that the draft law still has overlapping standards between forms of commendation at different levels. In particular, some standards for awarding medals and badges are still qualitative.
Delegate Nguyen Ngoc Phuong, Quang Binh delegation, commented: “I think the Politburo’s announcement on the Law has gone from being too loose to being too tight. The Politburo has stipulated that all Ministries and branches at the Department level and above are not to be commended, in which our Law states that an Emulation Fighter must have 5 years of Government Merit Certificates, 5 years of Emulation Fighter Certificates to have 5 years of First Class Labor Medals, 5 years of Third Class Labor Medals… In such a spirit, it is inconsistent and needs to be adjusted. I propose that the criteria for the title of Emulation Fighter at the grassroots level must have initiatives, scientific topics at the provincial level, which is very difficult, especially for those who are not provincial leaders.”
Agreeing with this opinion, delegate Nguyen Thanh Thuy, Binh Dinh delegation, said that it is appropriate to change the time limit for the state award to only 3 years, and at the same time, there should be clear and appropriate regulations on rewards and punishments.
“Recently, many forms of rewards have had a great impact, motivating all classes in society to participate in the task of socio-economic development. However, there should also be a form of deprivation of rewards. I suggest that you guys study and add more. Regarding the subjects of rewards, I see that they cover cadres, civil servants, armed forces and the people, but I also want to suggest that you guys clarify which subjects we should regularly praise and which subjects we should praise for their contributions.”
Based on the comments of members of the National Assembly's Committee on Social Affairs, the Drafting Committee of the Law on amending and supplementing a number of articles of the Law on Emulation and Commendation will compile a report and submit it to the National Assembly in the upcoming session./.
