Director forged police general's signature to defraud billions
When Duc was the director of Phan Khang Company - a branch in Can Tho City, this young man forged the handwriting of the Major General of the Fire Police of Can Tho City to embezzle billions of dong.
Can Tho City People's Court has just held a first-instance trial of the criminal case against Nguyen Tri Duc (28 years old, residing in Can Tho City), former director of Phan Khang Company, Can Tho branch.
According to the indictment, Phan Khang First Shopping Center Company Limited (Phan Khang Company) is headquartered in Ho Chi Minh City, trading in electrical appliances, refrigeration, household appliances and some other items. In Can Tho City, this company has two branches in Ninh Kieu District and Binh Thuy District.
In 2012, Duc signed a labor contract with Phan Khang Company and was assigned to work as a sales staff at the head office. In April 2014, Duc was appointed as Director of Phan Khang Company Branch 2.
One year later, Duc continued to be appointed as Director of Phan Khang Company, Branch 1.

In April 2015, to have money to gamble on football and pay off debts, Duc took advantage of his position and authority as director to direct his subordinate, Ngo Thi My Nhung (store manager), to release goods from the warehouse for Duc to sell on the market.
Duc also asked Nguyen Kim Thoa (chief accountant) not to issue invoices, not to enter the goods that had been sold into the company's sales management system, and to falsely report to the company that the goods that Duc had taken for sale were still in stock.
Duc deceived the two employees by saying that he took the goods to sell to increase sales for the company. Before that, Duc had also paid the sales money to the company many times, so the two employees did not know that their boss sold the goods to embezzle the money.
From April 2015 to February 7, 2017, Duc repeatedly took goods out of the warehouse and hired a truck to transport them to Ho Chi Minh City, asking for help from sellers. Duc paid commissions to the two sellers totaling 280 million.
On July 25, 2016, upon hearing that an audit team from Phan Khang Company was coming to inspect, Duc asked the store manager to check the goods that Duc had taken and sold without paying for them. After the inspection, Duc still owed the company more than 10.8 billion VND.
At this time, Duc borrowed 4.5 billion from his biological father to pay into the company. For the remaining amount, fearing that the audit team would discover it, Duc hired two fake seals of the Can Tho City Sports Center and the Can Tho City Fire Police.
Duc drafted an economic contract to provide a procurement package and equipment for the Can Tho City Fire Police Department for 6 billion VND; and the Can Tho City Sports Center for 1.6 billion VND.
Duc forged the signature of Major General Tran Thi Ngoc Dep - Director of the Fire Police Department of Can Tho City and the signature of Ms. Huynh Minh Phuong - Acting Director of the Sports Center of Can Tho City. Then, Duc stamped the forged signatures and gave these contracts to the Director of Phan Khang Company to sign. Thinking that these were real contracts, the Director of Phan Khang Company signed the two contracts. Later, the auditors did not find anything.
Later, Duc repeatedly asked employees to export goods so that he could sell them for his own use. On February 8, Phan Khang Company saw a significant drop in sales, so it conducted a surprise, comprehensive inspection of its business, checked inventory on the sales management system and inspected the warehouse... and discovered that Duc had embezzled more than VND23 billion worth of goods. On February 11, Phan Khang Company owner went to Can Tho City Police to report Duc's actions.
On February 14, Duc turned himself in to the police. During the investigation, Can Tho City Police prosecuted Nguyen Tri Duc for "Abuse of trust to appropriate property and Forgery of seals and documents of agencies and organizations".
The indictment of the People's Procuracy of Can Tho City prosecuted Nguyen Tri Duc for the above two crimes. In which, the crime of Fraudulent appropriation of property, Duc was prosecuted by the People's Procuracy of Can Tho City under Point a, Clause 4, Article 140 of the Penal Code with the highest penalty being life imprisonment.
At the trial, because the victim's representative had just received authorization and did not yet fully understand the case, he requested the court to postpone the trial to study the case file. The panel of judges decided to postpone the trial at the victim's representative's request./.
