In recent days, the story of 'a Department full of leaders' in Hai Duong has 'heated up' again with the news that the Director of the Department of Home Affairs specially appointed his son.

In the conclusion of the inspection of the Ministry of Home Affairs on the appointment and recruitment of officials at the Department of Labor, Invalids and Social Affairs of Hai Duong province, it was clearly stated that two civil servants were appointed to the position of deputy head of department when they did not fully meet the standards of the administrative civil servant rank. As of October 15, 2016, the Department of Labor, Invalids and Social Affairs of Hai Duong had 6 out of 9 specialized departments exceeding the number of deputy heads by 8 people.

Notably, Director of Hai Duong Department of Home Affairs Pham Van To signed a decision to appoint his son Pham Van Khang (born in 1980) to a department-level position without taking a civil service exam. When the Ministry of Home Affairs inspected, Mr. To's son voluntarily submitted a resignation letter.

Responding to the press, Mr. Pham Van To said, "The mistake was reported by my subordinates, so I did not consider it carefully... I have asked to accept the disciplinary action before the leaders of Hai Duong province."

Former Deputy Minister of Home Affairs Thang Van Phuc said that the Law on Civil Servants has specific regulations: "You have to take an exam to become a civil servant, then the process will be used to promote and appoint you. If you do not comply, it is a violation and there is an inspection conclusion, so you will be handled based on that."

In response to the recent inspection conclusions of the Ministry of Home Affairs showing that many localities have "surplus" officials, the former Deputy Minister of Home Affairs affirmed that the law clearly stipulates that each level has 1 chief, 2 deputies or 3 deputies, so the redundant appointments show non-compliance with the law and have some personal or local interests.

After the recent inspection conclusions of the Ministry of Home Affairs, National Assembly delegate Pham Tat Thang - Vice Chairman of the Committee for Culture, Education, Youth, Adolescents and Children said that two problems could be seen in the inspected localities and units: lack of respect for the law; lack of strict public service discipline and in the arrangement and promotion of cadres there were favoritism, relationships and acquaintances.

“It is worth noting that this phenomenon has been reported by the press recently as well as the results of inspections and checks have shown that it is no longer an isolated phenomenon, but has appeared in many places, so this is a worrying situation. It is also possible to raise the question of whether there is a situation in our public discipline where “the superiors do not listen to the subordinates” and do not implement it?!” – delegate Pham Tat Thang raised the question.

This National Assembly delegate also affirmed that an appointment without a convincing reason for job requirements and lacking standards and conditions cannot be said to be in accordance with the procedure.

Also related to personnel work, when evaluating the report on anti-corruption work in 2016, the National Assembly's Judicial Committee frankly stated that National Assembly deputies, voters and the press reflected that in the work of mobilizing and appointing officials, there were some cases of abusing regulations to mobilize and appoint officials who did not meet the conditions, standards, qualities, and abilities, were not truly typical, and lacked practical experience, such as relatives, family members...

In addition, the current Law does not yet stipulate the prohibition of leaders appointing relatives to leadership positions in agencies, organizations, and units under their management, leading to the phenomenon of "the whole family holding positions of authority" still... following the correct procedure!?

Therefore, the Judiciary Committee recommends that attention and research should be paid to ensuring that talented people are both respected and that abuse of power for personal gain is avoided in personnel work./.
