For the first time speaking at the Provincial People's Council forum, Director of the Department of Natural Resources and Environment Vo Duy Viet explained the current situation, causes and solutions for compensation and site clearance, resettlement in investment projects in the province, especially the resettlement projects of Ban Ve hydropower plant, Hua Na hydropower plant, Dong Hoi industrial park, Hoang Mai...
The question-and-answer session for Director Vo Duy Viet had 15 delegates questioning, which was the most questioned content among the 4 groups of issues raised at this session. However, the key issue that the Provincial People's Council requested to question and answer at the session was the work of compensation for site clearance, resettlement of projects, which was questioned by few delegates of the People's Council, but mainly focused on the contents under the authority of state management and the advisory responsibility of the industry in mineral exploitation; environmental pollution; granting and using residential land, production land; converting agricultural land to serve the construction of new rural areas, etc.

Responding to delegate Lu Dinh Thi (Que Phong) about the solution for compensation for residential land, adjacent land before 1980 and forestry land with the current status of people growing agricultural crops and long-term industrial crops, Director Vo Duy Viet said: Residential land with adjacent gardens and ponds formed before 1980, if there are legal documents or if there are none but they have been recorded in the commune's land registry, when applying compensation, it will be considered residential land for the entire garden and pond area. And for cases where there are documents but the actual measured area is larger than the recorded documents, if there is no dispute, compensation will be made according to reality; in cases where there are no documents and they are not recorded in the local land registry, this is a difficult problem. With the function of the industry, the Department has submitted a report requesting direction from the Ministry of Natural Resources and Environment, but there is currently no official response. The issue of compensation for forestry land that people are currently using to grow long-term agricultural and industrial crops, in principle, is compensation according to land use planning. However, from the perspective of ensuring farmers' rights and ensuring the current production value of the people, the industry has proposed a plan to implement compensation according to forestry land planning, then provide support twice for forestry land and other support.
The Director of the Department of Natural Resources and Environment also suggested that all levels and sectors should learn from experience in planning work to ensure quality, and after the planning is made public for officials and people to know and manage the planning. Only then can compensation ensure fairness between those who implement correctly and those who violate.
Responding to delegate Le Quang Dat (Thanh Chuong) about compensation measures for the "leopard skin" forest area in the resettlement area of Ban Ve hydropower plant, the Director of the Department of Natural Resources and Environment said: These are forest areas planted in other types of forests of forestry farms, and this forest planting is mainly using borrowed capital and with a very large compensation amount, up to hundreds of billions of VND. According to regulations, this compensation belongs to the scope of settlement of the investor, which is the Management Board of Hydropower Plant 2, however, this agency is currently refusing to implement it, because according to them, this is an item that arose after the total estimate of the project was made, so it cannot be supplemented. The industry's viewpoint is to request the People's Committee of Thanh Chuong district to direct the preparation of a compensation plan and submit it to the relevant agencies, from which it will recommend to the Provincial People's Committee to assign specialized agencies to study and handle it.
Responding to delegates Lo Xuan Vinh (Que Phong), Moong Van Hoi (Tuong Duong) about solutions for resettled households and ensuring the lives of people in the Ban Ve Hydropower Reservoir, Director Viet admitted: "This is a very difficult problem because we do not know what to base on to implement it". However, he also gave a specific plan, if any household has measured, compensation will be made according to the actual measurement, if any household has not measured, compensation will be based on the regulation of no more than 1000m2/household, including 400m2 of residential land and 600m2 of garden land.
Some issues have not been answered by the Director of the Department of Natural Resources and Environment due to the expiration of the prescribed time or under the authority of the Provincial People's Committee. Chairman of the Provincial People's Committee Ho Duc Phoc and Vice Chairman of the Provincial People's Committee Dinh Viet Hong have given specific explanations. Comrade Ho Duc Phoc frankly admitted: "The implementation of resettlement of Ban Ve Hydropower Plant currently has some problems, originating from the fact that we have implemented the wrong procedures from the beginning, because compensation, site clearance, and resettlement are the responsibility of the local government, not the investor". He also emphasized: “We will focus on solving the current problems. However, there is no local funding source, so the solution is that after this meeting, the Provincial People's Committee will be determined to work with the Vietnam Electricity Group to resolve the issues according to the principle that the arising problems will continue to be supplemented and overcome, including compensation for the area of leopard forest, adjusting and repairing the shortcomings at the Ban Ve hydropower resettlement area. At the same time, we commit to focus on providing people with income, stabilizing their lives through production projects, ensuring that people's lives are better than in their old place."
Regarding the resettlement of Vinh - Cua Lo road (72m), comrade Ho Duc Phoc said: This issue has been directed to be implemented and when the resettlement area was determined, the people did not agree and requested to live on the land that had been assigned to the enterprise. With the viewpoint of putting the interests of the people first, the Provincial People's Committee has worked and reached an agreement with the enterprise to have a resettlement location according to the wishes of the people and is carrying out the procedures, when there is money, it will be carried out immediately. The Provincial People's Committee will direct its apparatus to work faster and more decisively, ensuring the time schedule requirements.
Concluding the questioning, comrade Tran Hong Chau stated: The responsibility for site clearance is the local government; leaders of districts, cities and towns need to coordinate with specialized agencies of the Provincial People's Committee to properly resolve this issue, not relying on investors. Attracting investment projects to the area must meet the factors of peace of mind and social security. Therefore, functional agencies as well as investors must properly resolve welfare projects, ensure stability, and improve the lives of resettled people better than their old places. Carry out propaganda and mobilize people in the project implementation area to understand the benefits of the project to voluntarily comply as well as the responsibility of grassroots officials in coordinating to resolve related issues. The Provincial People's Committee and specialized sectors pay attention to allocating capital for appraisal, especially for key projects, including compensation, site clearance, resettlement, and stabilizing the lives of people in resettlement areas, contributing to the peace of mind of the people during the implementation of works and projects in the province.
Prioritize funding to improve the quality of school sanitation facilities
Regarding the Education and Training sector, there were 10 questions focusing on 3 main issues: School hygiene, revenue and expenditure management in schools; results of implementing Resolution 350/2010/NQ-HDND on converting preschool types. At the beginning of the questioning session, delegate Nguyen Huu Truong asked Mr. Le Van Ngo - Director of the Department of Education and Training to explain more clearly about the inspection of revenue and expenditure in schools, especially violations and handling of violations? Delegate Le Van Tri questioned that the regular expenditure budget for schools is not more than 4%, which is too little, forcing schools to collect other amounts in addition to the 6 prescribed amounts to ensure the quality of teaching and learning. So how does the Department advise the Provincial People's Committee and the financial sector to allocate funds to limit unregulated amounts?
Some delegates questioned that according to the explanatory report of the Department of Education and Training, the whole province currently has 1,571 staff working in school health, but only 557 are full-time staff, the rest are part-time. So what is the cause of this situation and what is the roadmap to solve it when every year hundreds of medical students graduate without jobs?

Responding to voters' questions, after explaining the results of the inspection of the revenue and expenditure at the beginning of the year and the issue of inadequate sanitation facilities, Mr. Le Van Ngo said that the industry determined that the main responsibility belonged to the principal, teachers and mass organizations in the school and the first thing was to change the awareness of this team. Regarding the current lack of specialized medical staff in schools, Mr. Ngo admitted that besides difficulties in funding and balancing the budget, one of the main reasons was that schools did not really care about this issue.
At the end of the question and answer session, delegates continuously asked questions related to the issue of public concern recently, which is the conversion of preschool types and the increase in tuition fees at high-quality preschools. Responding to questions from delegates An Chung (Do Luong) and Nguyen Thi Phuoc (Yen Thanh) about determining responsibility in the incident of preschools simultaneously increasing tuition fees according to the high-quality model without guidance from the Ministry of Education and Training, Mr. Le Van Ngo said that in reality, the units were too hasty in increasing tuition fees without guidance from the Ministry of Education and Training, but the industry's viewpoint is to continue to advise so that high-quality preschools can develop other sources of income to improve the quality of teaching and child care, and build a typical model of socialization.
Not satisfied with the explanation of the Director of the Department of Education and Training, delegate An Chung continued to question the Provincial People's Committee which had issued Decision 87 on the suspension and temporary collection of preschool tuition fees, but what the public was concerned about was when the temporary collection would last? Mr. Ngo affirmed that the Education sector would follow the decision of the Provincial People's Committee, temporarily collecting fees until the people agreed and parents accepted, then implementing the new form.
Also in the question and answer session this morning, the questions of the Delegates related to the inadequacies in the policy of exempting and reducing tuition fees for children of policy beneficiaries, especially for preschool children; the problem of handling chemicals after experiments and damaged chemicals still accumulated in school warehouses... were explained by the Director of the Department of Education and Training in turn, in the direction that the sector has tried and has many solutions to resolve the problem as well as requested the competent agencies and the Provincial People's Committee to consider and resolve it, but the most difficult problem is still funding, hoping that the delegates will share the difficulties with the Education sector.
Concluding the question and answer session related to the education sector, comrade Tran Hong Chau suggested that not only the education sector but also all sectors must pay attention to school hygiene, not considering this a small issue but must identify this as the responsibility and obligation of the whole society in ensuring health and the best conditions for the young generation. Prioritize funding sources, mobilize social resources, improve the quality of school sanitation works. Regarding the management of revenue and expenditure in schools, the education sector must strengthen management, not allowing violations, especially revenues outside of state regulations. Step up inspection, strictly and thoroughly handle and widely announce so that parents and students can participate in monitoring. Regarding the process of converting kindergartens, the Provincial People's Council suggested that the education sector coordinate with localities to properly implement the process, publicly, transparently, fairly, democratically and in accordance with the actual situation.
Evaluating the question and answer session at the 3rd session of the 16th Provincial People's Council, comrade Tran Hong Chau affirmed: The Standing Committee of the Provincial People's Council highly appreciated the serious preparation and responsibility of the People's Committee and related sectors and fully answered the questions at the session. Besides, there are still some shortcomings and limitations. On the side of the sectors, the preparation of the report and answer to the questions is still long, not focusing on the main content of the questions. The roadmap and solutions for some issues have not been clearly defined. On the side of the Provincial People's Council delegates, when raising questions, the questions are still long, some issues are not clear. Some delegates raised issues that are not under the authority of the sector being questioned. He requested: From the issues questioned at the session, the Provincial People's Committee and departments and sectors should include them in the 2012 work program, promote advantages, overcome disadvantages to effectively implement the recommendations raised by delegates and voters; At the same time, report the results of the settlement at the 4th and 5th sessions. Request the Committees, Groups, Provincial People's Council delegates and voters to continue to monitor the promises of the sectors to answer the questions raised at this session so as not to have to question again at the next session. |
