Delegate Hien cited the Tecco apartment project in Tan Phuc block, Vinh Tan ward, with a scale of 1,000 households, but the construction process adjusted the planning and there was no more space to build a cultural house. People living in this apartment building had to rely on Tan Thinh apartment building.
"Why is it necessary to adjust the planning and is this adjustment in accordance with regulations and how to handle this issue?" - delegate Ngo Thi Thu Hien asked.
Delegate Ngo Thi Thu Hien reflected and compared with Conclusion No. 551/KL-UBND (dated September 13, 2019) of the Provincial People's Committee and the question-and-answer session at the 15th session of the 17th Provincial People's Council (dated July 21, 2020), on compliance with the law on investment, construction, land and management and use of apartments in Nghe An province. Accordingly, in Vinh city, there are 2 apartment buildings that have not yet paid land use tax to the State budget, have not been granted Land Use Right Certificates but have been sold and handed over to people for use.

“This is an act that shows the investor’s disregard for land laws and the limitations in land management of construction by state management agencies. I request the Director of the Department of Construction to clarify this inadequacy,” said delegate Hien.
Strictly handle investors who violate regulations
Clarifying the concerns of the delegates, Director of the Department of Construction Nguyen Truong Giang said: Vinh Tan urban area was approved for planning in 2005, and the master plan was adjusted in 2007. From 2007-2018, this urban area had 4 local planning adjustments.
According to the planning from the beginning to the final planning adjustment, this urban area does not have a cultural house, not using the area for building the cultural house for other purposes. The Director of the Department of Construction admitted that this was a shortcoming of the investor. The adjustment of the planning for building apartment buildings is regulated by the Law.

Regarding reflectionviolations in apartment buildings, Director of the Department of Construction Nguyen Truong Giang said: Through inspection, it was found that the 2 apartment buildings of the Petroleum Mineral Company had many violations such as: not paying land use tax, many problems with construction quality, fire prevention, fire fighting, environmental protection...
Regarding the violations of these apartment buildings, the Department of Construction has sent 5 documents requesting the investor to correct the violations. Initially, the investor has corrected the environmental protection, fire prevention and fighting, and some items of the project.
The fact that investors have not paid land use fees to the State budget is a violation of regulations. The Department of Construction has sent a document to the Provincial People's Committee, on that basis requesting investors to fulfill their obligation to pay land use tax. If investors still deliberately delay in paying taxes, the Provincial People's Committee is requested to transfer the case to the competent authority to investigate the violation.

Regarding this issue, Chairman of the Provincial People's Council Nguyen Xuan Son suggested that it is necessary to do a good job in planning and planning appraisal. For investors who deliberately delay paying land use fees, the Chairman of the Provincial People's Council suggested that the Provincial People's Committee have strict solutions.

“The current problem in apartment buildings in the city is the issuance of housing ownership certificates to households. Many apartment buildings do not have a community center plan. I request that relevant authorities provide guidance on how to resolve this,” said delegate Lien.
Regarding this issue, Vice Chairman of Vinh City People's Committee Le Sy Chien said that administrative management work covers many areas. For this work, Vinh City People's Committee has issued a project on administrative management of apartment buildings in the area.
Accordingly, focusing on 5 contents: bringing residents in apartment buildings into blocks and hamlets for management, household registration management, establishing management boards, issuing certificates of housing use rights, naming streets and house numbers.

The Vice Chairman of Vinh City People's Committee informed that there are currently 83 apartment building projects in the city. Of these, 69 projects have been occupied in 17 wards and communes, the remaining projects are under construction.
The solution to administrative management in apartment buildings in the city is to establish residential groups in apartment buildings to merge into adjacent blocks and hamlets.
At the same time, coordinate with Vinh City Police to carry out procedures for temporary residence registration, temporary absence, and household registration for households. Currently, household registration management is carried out at 65/69 apartment buildings, with about 23,000 residents. 46/69 apartment buildings have established management boards. To date, 5,800 certificates of housing use rights have been issued, but more than 800 households have not been issued to households because investors have not completed the procedures.
